CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 758 <br /> <br /> AN ORDINANCE AMENDING SECTION 2-2.50 OF ARTICLE 4 <br /> (TENTATIVE MAP), CHAPTER 1 (SUBDIVISIONS), TITLE II <br /> (ZONING AND DEVELOPMENT) OF THE ORDINANCE CODE OF <br /> THE CITY OF PLEASANTON, SAID ORDINANCE BEING AN URGENCY <br /> MEASURE AND EFFECTIVE IMMEDIATELY. <br /> <br /> WHEREAS, SB 977 (Chapter 1536, Gregorio) was enacted into <br /> <br />law by the 1973-1974 session of the State Legislature, which <br />consisted of a comprehensive revision of the State Subdivision <br />Map Act; and <br /> <br /> WHEREAS, the operative date of that statute is March 1, <br /> <br />1975; and <br /> <br /> WHEREAS, the City Council desires that the Planning Com- <br />mission approve tentative maps unless the matter is appealed to <br />the Council pursuant to law; and <br /> <br /> WHEREAS, pursuant to Section 4.55 of Chapter 1536 (Govern- <br /> <br />ment Code Section 66474.7) it is necessary that if the respon- <br />sibility in approving tentative maps is delegated to the Planning <br />Commission there shall be a right of appeal to interested <br />persons; and <br /> <br /> WHEREAS, it is the Council's desire to continue the current <br />practice of having the Planning Commission approve tentative <br />maps; and <br /> <br /> WHEREAS, after the staff makes its review of the new Act <br /> <br />and suggested language prepared by the League of California <br />Cities Legal Subcommittee on the Subdivision Map Act the Council <br />will take under consideration revisions to the appropriate pro- <br />visions of the Ordinance Code of the City of Pleasanton regulating <br /> <br />subdivisions and <br /> · . . ; <br /> <br /> <br />
