RECOMMENDATION <br /> 1. Find that the conditions described in the California Environmental Quality Act <br /> (CEQA) Guidelines Section 15162 have not occurred as described in the Addendum <br /> to the Housing Element Update and Climate Action Plan General Plan Amendment <br /> and Rezonings Supplemental Environmental Impact Report (SEIR) and find that the <br /> previously prepared SEIR and associated documentation, including the adopted <br /> CEQA Findings and Statement of Overriding Considerations, and the Addendum to <br /> the SEIR, and the memo to the Addendum are adequate to serve as the <br /> environmental documentation for this project and satisfy all the requirements of <br /> CEQA; <br /> 2. Find that the proposed PUD Development Plan and the amendment to the <br /> Development Agreement are consistent with the General Plan; <br /> 3. Make the PUD findings for the proposed Development Plan as stated in the May 13, <br /> 2015 Planning Commission staff report (pages 21-24 in Attachment 7); <br /> 4. Find that the exceptions to the Housing Site Development Standards and Design <br /> Guidelines as stated in the May 13, 2015 Planning Commission staff report <br /> (pages 12-13) are appropriate; <br /> 5. Adopt a resolution approving the Affordable Housing Agreement for the project <br /> (Attachment 4); <br /> 6. Introduce the draft ordinance approving the First Amendment to the Development <br /> Agreement for the project (Attachment 5); <br /> 7. Introduce the draft ordinance approving Case No. P15-0170, PUD Major <br /> Modification to City Council Ordinance No. 2030 to modify the minimum density <br /> requirement of 30 dwelling units/acre to a density of 15.9 dwelling units/acre <br /> (Attachment 2); <br /> 8. Introduce the draft ordinance approving Case No. PUD-81-30-55M, a PUD Major <br /> Modification to amend the Housing Site Development Standards and Design <br /> Guidelines for Site #9 to specifically change the minimum and maximum density <br /> from the required 30 dwelling units/acre to the proposed 15.9 dwelling units/acre for <br /> the 5.9-acre site (Attachment 3); and <br /> 9. Introduce the draft ordinance approving Case No. PUD-81-30-89D, PUD <br /> Development Plan for the construction of 94 condominium units and related on-site <br /> improvements, subject to the conditions of approval listed in Attachment 1. <br /> FINANCIAL STATEMENT <br /> The project would be expected to generate revenues to cover its costs of service. <br /> Increases in property tax would be used to provide services, such as police and fire <br /> services to the occupants of the dwelling units.
