BACKGROUND <br /> The proposed omnibus ordinance and resolution amending the Master Fee Schedule is <br /> an annual process to present for City Council consideration minor and non-controversial <br /> changes to the Pleasanton Municipal Code and Master Fee Schedule as a single <br /> action. Several of these code amendments are proposed to reflect changes in the <br /> underlying State law. Also, City staff throughout the year note code provisions which do <br /> not reflect actual City practices, refer to out of date titles and references, or otherwise <br /> merit minor revision. Overall, these items are insubstantial such that a stand-alone City <br /> Council agenda item is not warranted. <br /> DISCUSSION <br /> The proposed omnibus ordinance and related resolutions address the following: <br /> §1.20.020 Campaign Reform Definitions to reflect current State law — The municipal <br /> code's references to the State's Political Reform Act uses definitions "as they appear in <br /> 1994". This is modified to state "as amended" so as to always reflect current State law. <br /> §2.29.030 Clarify that Youth Commissioners are Not Subject to Work Permits — Youth <br /> serving on the Youth Commission are not 'working' as that term is defined by State law, <br /> so no work permit is required. <br /> §3.32.010 Update Alternate Bidding Procedures Contract Amounts to reflect State Law <br /> Changes - California law provides several processes for bidding public contracts. <br /> These include maintaining a list of qualified contractors for informal bids. The City <br /> adopted this alternate bidding procedure in 1991 and its use has been successful. <br /> State law changed to update the value of projects which can use this alternative <br /> process. The proposed amendment updates the Municipal Code to reflect most recent <br /> amounts. <br /> §6.40.020 Taxi Business Owner Minimum Age of 25 - The proposed amendment sets a <br /> minimum age for taxi business owners at 25 years old (still subject to experience as <br /> reasonably determined by the Chief of Police in §6.40.030). This change is in response <br /> to applications from persons under 21 years of age, which Police Department staff <br /> found reflected insufficient driving and business owner experience when third party <br /> safety can be at issue. Note: Minimum taxi driver age remains 21 (§6.40.140.A.), this <br /> change is for a taxi business owner. <br /> Delete Chapter 6.68 Extrasensory Consulting to Comply with Court Decisions — It has <br /> been brought to the City's attention that California courts (including the State Supreme <br /> Court - which sets precedent for Pleasanton and other California communities) have <br /> ruled that persons claiming to be fortunetellers are Romani / Roma persons exercising <br /> free speech and cannot be prohibited from offering such services, nor be subject to <br /> licensing or operational regulations not imposed on other businesses. Due to these <br /> First Amendment and Equal Protection concerns, Chapter 6.68 is proposed to be <br /> Page 3 of 7 <br />
