Such appeal must be sub- <br /> mitted in writing to the City Clerk within twenty (20) days <br /> of the decision being appealed and shall briefly state facts <br /> and the grounds of the appeal and be signed by the appellant. <br /> Upon receipt of said appeal the City Clerk shall set a date <br /> for hearing before the City Council. The Director shall sub- <br /> mit a report to the Council setting forth the factual deter- <br /> minations required by Section 2-17.05, along with any depart- <br /> mental recommendations. The Council may conduct a public <br /> hearing on the appeal, however, compliance with Section 2-5.08 <br /> (Public Hearing and Notice) is not required. Following the <br /> hearing of any such appeal the City Council may affirm, re- <br /> verse, or modify the action of the Director and may take any <br /> action thereon which would have been authorized in the first <br /> instance. The action of the City Council on any such appeal <br /> shall be final and conclusive. <br /> <br />Section 2-17.08. New Property Development. Any person desiring <br /> to cut down, destroy, or remove one or more trees on any <br /> property in the City which is related to the development of <br /> property requiring design review-shall. make application to <br /> the Design Review Board for such removal as a part of the <br /> regular design review application. . ....... <br /> <br /> The applicant shall provide a tree siurvey plan specifying <br /> the precise location, size, and species of all existing trees <br /> on the property with a special notation of those classified <br /> as Heritage Trees. The survey shall also indicate which <br /> trees are proposed for removal. <br /> <br /> This tree survey plan shall be forwarded to the Director who <br /> shall, after making a field visit to the property, indicate <br /> in writing which trees are recommended for preservation <br /> using the same standards set forth in Section 2-17,05. This <br /> report shall be made part of the staff report to the Design <br /> Review Board upon its consideration of the application for <br /> new property development. <br /> <br /> The Design Review Board through its site and landscaping <br /> plan review shall endeavor to preserve all trees recommended <br /> for preservation by the Director. The Design Review Board <br /> may determine that any of the trees recommended for preserva- <br /> tion should be removed, if there is evidence submitted to it, <br /> that due to special site grading or other unusual character- <br /> istics associated with the property the preservation of the <br /> tree(s) would significantly preclude feasible development <br /> of the property. <br /> <br /> Approval of final site and landscape plans by the Design <br /> Review Board indicating which trees are to be removed shall <br /> constitute the tree permit for the purpose of this chapter. <br /> An appeal from the decision of the Design Review Board may <br /> <br /> -4- <br /> <br /> <br />
