Such appeal must be sub- mitted in writing to the City Clerk within twenty (20) days of the decision being appealed and shall briefly state facts and the grounds of the appeal and be signed by the appellant. Upon receipt of said appeal the City Clerk shall set a date for hearing before the City Council. The Director shall sub- mit a report to the Council setting forth the factual deter- minations required by Section 2-17.05, along with any depart- mental recommendations. The Council may conduct a public hearing on the appeal, however, compliance with Section 2-5.08 (Public Hearing and Notice) is not required. Following the hearing of any such appeal the City Council may affirm, re- verse, or modify the action of the Director and may take any action thereon which would have been authorized in the first instance. The action of the City Council on any such appeal shall be final and conclusive. Section 2-17.08. New Property Development. Any person desiring to cut down, destroy, or remove one or more trees on any property in the City which is related to the development of property requiring design review-shall. make application to the Design Review Board for such removal as a part of the regular design review application. . ....... The applicant shall provide a tree siurvey plan specifying the precise location, size, and species of all existing trees on the property with a special notation of those classified as Heritage Trees. The survey shall also indicate which trees are proposed for removal. This tree survey plan shall be forwarded to the Director who shall, after making a field visit to the property, indicate in writing which trees are recommended for preservation using the same standards set forth in Section 2-17,05. This report shall be made part of the staff report to the Design Review Board upon its consideration of the application for new property development. The Design Review Board through its site and landscaping plan review shall endeavor to preserve all trees recommended for preservation by the Director. The Design Review Board may determine that any of the trees recommended for preserva- tion should be removed, if there is evidence submitted to it, that due to special site grading or other unusual character- istics associated with the property the preservation of the tree(s) would significantly preclude feasible development of the property. Approval of final site and landscape plans by the Design Review Board indicating which trees are to be removed shall constitute the tree permit for the purpose of this chapter.
