a. The condition of the tree with respect to disease, <br /> general health, damage, public nuisance, danger of <br /> falling, proximity to existing or proposed structures, <br /> interference with utility service and whether or not <br /> the tree acts as host for a plant which is parasitic <br /> to another species of tree which is in danger of being <br /> exterminated by the parasite. <br /> <br /> b. The necessity to remove the tree in order to construct <br /> any proposed improvements to allow economic enjoyment <br /> of the property. <br /> <br /> c. The number of existing trees in the neighborhood or <br /> area on improved property and the effect removal would <br /> have upon the public health, safety, general welfare <br /> or residents and upon the property and beauty of the <br /> area. <br /> <br /> d. The topography of the land upon which the tree or trees <br /> are situated and the effect of removal thereof upon <br /> erosion, soil retention, and diversion or flow of <br /> Surface waters. <br /> <br /> e. Good forestry practices, i.e. the number of healthy <br /> trees that a given parcel of land will support. <br /> <br /> The Director may refer any application to any City depart- <br /> ment or commission for a report and recommendation. <br /> <br />Section 2-17.06. Action by Director, Findings. The Director <br /> shall issue a permit to remove a tree or trees if it is <br /> determined that one of the following conditions exist: <br /> <br /> a. The tree is in such a dangerous or hazardous condition <br /> as to threaten or endanger the safety or people, struc- <br /> tures, other property, or other heritage trees; <br /> <br /> b. The tree is dead, dying or diseased and good forestry <br /> practices cannot be reasonably undertaken to preserve <br /> the tree~ or <br /> <br /> c. Where the tree in question is not diseased or hazardous, <br /> the removal of tree is consistent with the purposes and <br /> intent of this chapter and in keeping with the health, <br /> safety and general welfare of the community. <br /> <br /> The Director shall notify the applicant in writing of the <br /> determination giving the reason for the application's approval <br /> or denial. <br /> <br />Section 2-17.07. Appeal. Any decision made by the Director to <br /> deny tree removal may be appealed by written application by <br /> any affected resident or property owner in the City of <br /> <br /> -3- <br /> <br /> <br />
