development; or so abundant their removal would not destroy <br /> the area's natural beauty or ecology or cause erosion. It <br /> is the intent of this ordinance to preserve as many "heritage" <br /> trees as possible on land about to be developed, through the <br /> development review process. <br /> <br />Section 2-17.02. Definitions. For the purpose of this chapter, <br /> certain words and terms used herein are defined as follows: <br /> <br /> a. "Heritage Tree" shall mean any of the following: <br /> <br /> 1. Any tree with a circumference of fifty-five (55) <br /> inches or more measured two and one-half feet above <br /> ground level. <br /> <br /> 2. Any tree thirty-five feet or more in height. <br /> <br /> 3. Any tree of particular historical significance <br /> specifically designated by official action. <br /> <br /> 4. A stand of trees the nature of which makes each <br /> dependent upon the others for survival. <br /> <br /> b. "Director" shall mean the Director of Public Works or <br /> his designated representative. <br /> <br />Section 2-17.03. Exceptions. The provisions of this Chapter <br /> shall not apply to fruit trees or, when part of an orchard, <br /> to nut bearing trees the product of which is used for <br /> commercial purposes. <br /> <br /> Article 2 <br /> <br /> Permit Procedure <br /> <br />Section 2-17.04. Permit Required. No person shall cut down, de- <br /> stroy or remove any heritage tree growing within the City <br /> limits from any property without a permit except as provided <br /> herein. <br /> <br />Section 2-17.05. Permit Procedures. Except as provided in Section <br /> 2-17.08, any person desiring to cut down, destroy or remove <br /> one or more heritage trees on any property in the City of <br /> Pleasanton shall make application to the Director. Said ap- <br /> plication shall contain the number, species, size and location <br /> of trees to be cut down, destroyed or removed and a brief <br /> statement of the reason for removal as well as any other <br /> pertinent information he may require. The permit, if granted, <br /> shall entitle the applicant to remove only those trees desig- <br /> nated by permit. Prior to the issuance of such permit, the <br /> Director shall visit and inspect the property, the tree or -~ <br /> trees in question, and the surrounding area and shall ascer- <br /> tain the following: <br /> <br /> <br />
