CITY COUNCIL OF TttE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 841 <br /> <br /> AN ORDINANCE AMENDING IN ITS ENTIRETY CHAPTER 10, TITLE II <br /> (ZONING AND DEVELOPMENT) OF THE ORDINANCE CODE OF THE CITY <br /> OF PLEASANTON RELATING TO THE PRESERVATION OF TREES ON PRI- <br /> VATE PROPERTY. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES ORDAIN AS FOLLOWS: <br /> <br />Section 1. Chapter 10, Title II (Zoning and Development) of the Ordin- <br /> ance Code of the City of Pleasanton relating to the Preserva- <br /> tion of Trees on Private Property is amended in its entirety <br /> as follows: <br /> <br /> Chapter 10 <br /> <br /> PRESERVATION OF TREES ON PRIVATE PROPERTY <br /> <br /> Article I <br /> <br /> Purpose and Definitions <br /> <br /> Section 2-17.01. Purpose and Intent. The City of Pleasanton <br /> lies largely in a valley in which substantial portions <br /> were and are covered by native or indigenous trees. The <br /> City recognizes that preservation of such trees enhances <br /> the natural scenic beauty, sustains the long term poten- <br /> tial increase in property values which encourages quality <br /> ~evelopment, maintains the ecology, moderates the effect <br /> of extreme temperatures, prevents erosion of topsoil, helps <br /> create an identity and quality in the City which enhances <br /> the attractiveness of the City to visitors and increases <br /> the oxygen output of the area which is needed to combat <br /> air pollution. For these reasons the Council finds that <br /> in order to promote the public health, safety and general <br /> welfare of the City of Pleasanton while at the same time <br /> recognizing individual rights to develop private property <br /> in a manner which will not be prejudicial to the public <br /> interest it is necessary to enact regulations controlling <br /> the removal and preservation of "heritage" trees within the <br /> City of Pleasanton. However, the Council also recognizes <br /> that under certain circumstances "heritage" trees may proper- <br /> ly be removed. Those circumstances include where "heritage" <br /> trees are dangerous; dead or diseased; so situated on unde- <br /> veloped land that their preservation would preclude feasible <br /> <br /> -1- <br /> <br /> <br />
