2) Conditional Use Permit (P14-0014): <br /> ® Operate a convenience market from 5:00 a.m. to 1:00 a.m.; <br /> ® Allow the sale of alcoholic beverages at the convenience market from 6:00 <br /> a.m. to 11:00 p.m.; <br /> ✓ Allow convenience market employees at the market from 1:00 a.m. to 5:00 <br /> a.m. for merchandise stocking; and <br /> IN Operate a drive-through carwash from 7:00 a.m. to 10:00 p.m. (a <br /> recommended condition of approval would limit the carwash hours to 7:00 <br /> a.m. to 9:00 p.m. during Standard Time and 7:00 a.m. to 10:00 p.m. during <br /> Daylight Saving Time). <br /> Two employees would staff the convenience market and would also oversee operations <br /> at the existing service station. <br /> Please refer to the attached Planning Commission staff report, dated August 27, 2014 <br /> for additional project information. <br /> PLANNING COMMISSION ACTION <br /> The Planning Commission held a public hearing on August 27, 2014, to review the <br /> subject applications. Detailed information on this meeting is provided in the attached <br /> excerpts of the Planning Commission minutes (Attachment 6). Four residents in the <br /> Fairlands neighborhood spoke, opposing the proposed project due to concerns relating <br /> to noise, traffic, hours of operation, and crime. One customer of the existing gas <br /> station, along with several representatives of 7-Eleven and/or the project applicant, <br /> spoke in favor of the proposed development. <br /> After receiving public testimony, the Commission recommended approval of the <br /> applications with a 3-2 vote (Commissioners Allen and O'Connor dissented), with the <br /> following modifications to staffs recommended conditions: <br /> 1. Add a new condition or modify an existing condition that would allow the Planning <br /> Commission's subsequent review of the Conditional Use Permit if operation of <br /> the convenience market or the drive-through carwash results in conflicts <br /> pertaining to noise, traffic, crime, or other impacts. <br /> 2. Modify Condition of Approval No. 4 of P14-0014 by revising the hours of <br /> operation for the carwash to 7:00 a.m. — 9:00 p.m. during Standard Time and <br /> 7:00 a.m. — 10:00 p.m. during Daylight Saving Time. <br /> Commissioner Allen stated that the proposed applications do not have the support of <br /> the nearby residents. She stated that she would support the proposal if: 1) alcohol <br /> sales were limited from 6:00 a.m. to 8:00 p.m. 2) the convenience store were to close at <br /> midnight; 3) the Conditional Use Permit were to be automatically brought back to the <br /> Commission for a follow-up review six months after the start of operation to determine if <br /> the business created any impacts related to traffic, noise, crime, and associated <br /> neighborhood compatibility issues; at such time, convenience store and alcohol sales <br /> hours could be extended if no adverse impacts were identified.
