were not supported by the majority of the Commission, Commissioner Allen did not vote <br /> in favor of the project. <br /> Commission Chair O'Connor stated that he would not support the project because the <br /> Conditional Use Permit would not be automatically brought back to the Planning <br /> Commission for follow-up review six months after the start of operation. He otherwise <br /> supported the project. <br /> DISCUSSION <br /> The attached Planning Commission staff report dated August 27, 2014 provides a <br /> detailed description and discussion of the proposed application including: site <br /> development; design elements; proposed uses; hours of operation, parking; traffic and <br /> circulation; noise assessment; tree removal; crime; project feedback received at the <br /> Planning Commission workshop of September 25, 2013; and public comments. <br /> As requested by the Planning Commission, staff has prepared a table comparing <br /> existing gas stations that also sell beer and wine in Pleasanton. Please see Attachment <br /> 10. <br /> Key points of concern raised by the public about the project include: <br /> • Traffic and Circulation: Additional vehicle traffic and the potential for illegal U- <br /> turns on W. Las Positas Boulevard; <br /> • Noise: Noise associated with carwash operations and other activities on the site; <br /> • Crime: Potential increases in crime associated with a new convenience market <br /> that sells beer and wine; and <br /> • Land Use Compatibility: The proposed convenience store would not be <br /> compatible with the residential character of the surrounding neighborhood. <br /> Staff carefully evaluated the concerns expressed by local residents about the project but <br /> believes that the proposed development conforms to the City's General Plan and is <br /> protective of the public health, safety, and general welfare for the following reasons: <br /> • The project would expand commercial uses within an existing commercial <br /> district in the City, allowing for more effective utilization of an already- <br /> developed property. <br /> • The site is adequately buffered from surrounding residential uses by major <br /> roadways or existing commercial uses. <br /> • The proposed store would provide a convenient place for residents to <br /> purchase staples (milk, bread, fruit) locally. <br /> • According to correspondence from the Pleasanton Police Department, and a <br /> review of service call data for similar uses in the City, the proposed use would <br /> not be expected to generate substantial increased demand for police service. <br /> • Because the project would combine uses on the site (gas, carwash, and <br /> convenience store), and is located in close proximity to other commercial <br /> uses, it would maximize the potential for pass-by trips, which is a means of <br /> reducing vehicle miles traveled. <br /> Page 5of7 <br />
