RECOMMENDATION <br /> 1. Find that the proposed project would not have a significant effect on the environment <br /> and adopt a resolution adopting the attached Negative Declaration (Attachment 2); <br /> 2. Find that the proposed PUD rezoning and Development Plan are consistent with the <br /> General Plan and the purposes of the PUD Ordinance; <br /> 3. Make the PUD and Conditional Use Permit findings as stated in the August 27, <br /> 2014, Planning Commission staff report (pages 21-24 and 24-25 in Attachment 5); <br /> 4. Introduce the attached draft ordinance approving Case PUD-102 (PUD rezoning and <br /> development plan), subject to the draft conditions of approval listed in Exhibit A <br /> (Attachment 1); and <br /> 5. Adopt a resolution approving Case P14-0014 (Conditional Use Permit), subject to <br /> the draft conditions listed in Exhibit A (Attachment 3). <br /> FINANCIAL STATEMENT <br /> The proposed project would be responsible for the payment of fees and for the costs of <br /> any required utility or infrastructure improvements. The project would incrementally <br /> increase the demand for City services and would add sales and property tax revenue. <br /> BACKGROUND <br /> Mr. Michael Roesbery, the property owner and business operator of the gas station and <br /> automobile service business located at 3192 Santa Rita Road, wishes to convert the <br /> existing automobile service building to a convenience market with a drive-through <br /> carwash facility and to construct an addition to the proposed convenience market while <br /> retaining the existing gas station operation. The convenience market would be a <br /> 7-Eleven store that sells alcoholic beverages (beer and wine). <br /> The project site is located in the Neighborhood Commercial (C-N) District. The C-N <br /> District does not allow a gas station with a convenience market or a drive-through <br /> carwash. Furthermore, the non-PUD zoning districts where a gas station with <br /> convenience store is allowed (the Freeway Commercial and Service Commercial <br /> Districts) do not allow the sale of alcoholic beverages. To pursue the proposed uses <br /> (convenience market with the sale of alcoholic beverages and a drive-through carwash), <br /> the applicant requests the zoning of the site be changed from the current C-N District to <br /> a Planned Unit Development — Commercial (PUD-C) District. The proposed PUD-C <br /> zoning would require a Conditional Use Permit for the operation of a convenience <br /> market with the sale of alcoholic beverages and drive-through carwash in conjunction <br /> with a gas station. As such, the applicant also requests the approval of a Conditional <br /> Use Permit in order to accommodate the proposed uses. <br /> The Planning Commission reviewed and recommended approval of the PUD rezoning <br /> and development plan and Conditional Use Permit applications at its meeting on August <br /> 27, 2014.
