THE CITY OF 1 �) <br /> °- "" i•� <br /> CITY COUNCIL AGENDA REPORT <br /> PLEASANTON. <br /> November 18, 2014 <br /> Community Development Department <br /> TITLE: CONSIDER THE FOLLOWING AT THE APPROXIMATELY 0.78-ACRE <br /> VALERO SERVICE STATION SITE LOCATED AT 3192 SANTA RITA <br /> ROAD: (1) INTRODUCTION OF AN ORDINANCE APPROVING A <br /> REZONING FROM THE C-N (NEIGHBORHOOD COMMERCIAL) <br /> DISTRICT TO THE PUD-C (PLANNED UNIT DEVELOPMENT — <br /> COMMERCIAL) DISTRICT; AND A PUD DEVELOPMENT PLAN TO <br /> CONVERT APPROXIMATELY 1,752 SQUARE FEET OF THE EXISTING <br /> APPROXIMATELY 2,634-SQUARE-FOOT AUTO SERVICE BUILDING <br /> TO A CONVENIENCE MARKET, CONVERT THE REMAINING FLOOR <br /> AREA OF THE BUILDING TO A DRIVE-THROUGH CARWASH, <br /> CONSTRUCT AN APPROXIMATELY 715-SQUARE-FOOT ADDITION <br /> TO THE PROPOSED CONVENIENCE MARKET, AND UNDERTAKE <br /> RELATED SITE AND BUILDING IMPROVEMENTS; AND <br /> (2) ADOPTION OF RESOLUTIONS APPROVING A CONDITIONAL USE <br /> PERMIT TO OPERATE A CONVENIENCE MARKET WITH THE SALE <br /> OF ALCOHOLIC BEVERAGES AND A DRIVE-THROUGH CARWASH <br /> IN CONJUNCTION WITH AN EXISTING SERVICE STATION; AND <br /> ADOPT THE NEGATIVE DECLARATION PREPARED FOR THE <br /> PROJECT <br /> SUMMARY <br /> The proposed applications would rezone the property to Planned Unit Development- <br /> Commercial (PUD-C) District and allow development and operation of a 7-Eleven <br /> convenience market with alcoholic beverage sales and a drive-through carwash in <br /> conjunction with the existing Valero gas station. The Planning Commission <br /> recommended approval of the applications on a 3-2 vote. Dissenting Commissioners <br /> generally supported the project, but desired: 1) more restrictive service hours for <br /> operation of the convenience store and sale of alcoholic beverages; and 2) that the <br /> Conditional Use Permit return for Planning Commission review six months after the <br /> initiation of project operations so that project impacts could be evaluated and <br /> adjustments to operating hours/alcohol sales be implemented, if warranted. <br /> PLANNING COMMISSION RECOMMENDATION <br /> Recommended approval of the applications subject to the Conditions of Approval as <br /> proposed by staff with modifications to: 1) close the drive-through carwash at 9:00 p.m. <br /> during Standard Time; and 2) allow the Conditional Use Permit to be brought back to <br /> the Planning Commission for mitigation or possible revocation, if necessary, should <br /> future problems arise pertaining to noise, traffic circulation, crime, etc. <br />
