BACKGROUND
On December 4, 2007, City Council approved a professional services agreement with
Mosaic Associates for the project for the not-to-exceed amount of $183,323. Mosaic
prepared detailed wetland/riparian plans and mitigation plans and assisted the City in
obtaining required permits from other agencies to allow the construction of the Bernal
Bridge. Mosaic also performed preconstruction surveys, construction monitoring, and
year one post-construction mitigation monitoring and reporting for this project.
On March 16, 2010, City Council approved Amendment No.2 with Mosaic Associates
for an amount not-to-exceed $115,194 to complete years two through five monitoring
and reporting requirements.
Post construction mitigation monitoring & reporting is required by the U.S. Army Corps
of Engineers, Regional Water Quality Control Board (RWQCB), and California
Department of Fish and Game for not less five years. In addition to the five years of
post construction mitigation monitoring, the RWQCB requires that riparian tree planting
be monitored for a minimum period of ten years (annually in years one through five,
followed by monitoring in years seven, nine and ten). The Second Amendment is
necessary so that Mosaic Associates can complete the RQWCB required reporting for
years seven, nine and ten.
DISCUSSION
Attached to this staff report and also serving as Exhibit "A-2" to the professional
services agreement amendment is the letter from Mosaic Associates including the
proposal for years seven, nine, and ten mitigation monitoring and reporting services. It
also includes a long term maintenance manual preparation service. Mosaic is
requesting the agreement limit be increased by $16,135 from $298,517 to $314,562.
Staff has reviewed the proposal and determined that the required services are included
and the corresponding fee is reasonable. Therefore, staff recommends that the Council
approve the attached Second Amendment.
Submitted by: Fiscal Review: /' Approvedd/,by:
/L /L.Cinit B if-an Dot n
Director Emily Wa ner Nelson Fialho
Community Development Director of Finance City Manager
Attachments:
1.
