BACKGROUND <br /> On December 4, 2007, City Council approved a professional services agreement with <br /> Mosaic Associates for the project for the not-to-exceed amount of $183,323. Mosaic <br /> prepared detailed wetland/riparian plans and mitigation plans and assisted the City in <br /> obtaining required permits from other agencies to allow the construction of the Bernal <br /> Bridge. Mosaic also performed preconstruction surveys, construction monitoring, and <br /> year one post-construction mitigation monitoring and reporting for this project. <br /> On March 16, 2010, City Council approved Amendment No.2 with Mosaic Associates <br /> for an amount not-to-exceed $115,194 to complete years two through five monitoring <br /> and reporting requirements. <br /> Post construction mitigation monitoring & reporting is required by the U.S. Army Corps <br /> of Engineers, Regional Water Quality Control Board (RWQCB), and California <br /> Department of Fish and Game for not less five years. In addition to the five years of <br /> post construction mitigation monitoring, the RWQCB requires that riparian tree planting <br /> be monitored for a minimum period of ten years (annually in years one through five, <br /> followed by monitoring in years seven, nine and ten). The Second Amendment is <br /> necessary so that Mosaic Associates can complete the RQWCB required reporting for <br /> years seven, nine and ten. <br /> DISCUSSION <br /> Attached to this staff report and also serving as Exhibit "A-2" to the professional <br /> services agreement amendment is the letter from Mosaic Associates including the <br /> proposal for years seven, nine, and ten mitigation monitoring and reporting services. It <br /> also includes a long term maintenance manual preparation service. Mosaic is <br /> requesting the agreement limit be increased by $16,135 from $298,517 to $314,562. <br /> Staff has reviewed the proposal and determined that the required services are included <br /> and the corresponding fee is reasonable.
