BACKGROUND <br /> The property for Tract 8159 is Parcel 1 of Parcel Map 10180, located on the south side <br /> of Stanley Boulevard and north of the Arroyo Del Valle, as shown on Attachments 1 and <br /> 2. This project will develop 12 single family detached residential lots. <br /> On August 20, 2013, the City Council approved PUD-97 for 13 residential lots, one <br /> existing and 12 new homes. Following City Council approval, Ponderosa Homes <br /> submitted an application for a Minor Subdivision which was approved by the Staff <br /> Review Board on October 24, 2013. The application proposed to subdivide an <br /> approximately 2.1 acre property at 4202 Stanley Boulevard into two parcels: Parcel 1 <br /> measuring approximately 1.9 acres and Parcel 2 measuring approximately 0.2 acres. <br /> Parcel 1 Parcel Map 10180 will create 12 single family lots with approval of this Final <br /> Map. Parcel 2 has existing home that will remain. <br /> On November 13, 2013, the Planning Commission approved an application of <br /> Ponderosa Homes for Vesting Tentative Map 8159 to subdivide an approximately 1.9 <br /> acre site located at 4402 Vineyard Avenue into 12 single-family home lots consistent <br /> with the PUD development plan for this site. <br /> City staff has reviewed the Final Map and other legal documents for Tract 8159. All <br /> submittals are in substantial conformance with the PUD and Tentative Map approvals. <br /> Development fees have been paid and a signed Subdivision Agreement has been <br /> submitted. <br /> DISCUSSION <br /> Proposed Improvements <br /> As shown on Attachment 2, this development proposes a new private street, Gyles <br /> Place, from Stanley Boulevard in a southerly direction. Gyles Place, a 32' wide private <br /> Street, will end with a fire truck turn around at the south end. <br /> The private street, bio-swales areas for the storm water treatment, and private utilities <br /> (street lights and storm drain systems within private streets)will be maintained by the <br /> Home Owner's Association. <br /> This project's Final Map includes an Irrevocable Open Offer of Dedication for Trail <br /> Easement at the south end of the project from the toes of the slope to more or less the <br /> center line of the creek. The staff recommends rejecting this Irrevocable Open Offer of <br /> Dedication for Trail Easement at this time with an option to accept it in the future as per <br /> the Subdivision Map Act. Acceptance will likely occur when additional development <br /> along the arroyo makes construction of the trail feasible. <br /> The owners of lots 4-7 will own the lot areas more or less up to middle of the Arroyo Del <br /> Valle including the area offered Irrevocable Open Offer of Dedication for Trail <br /> Easement. Each lot owner will be responsible for maintenance of these areas including <br /> weed abatement, trash collection, etc., as defined in the project CC&R, until the City <br /> accepts the Open Offer of Dedication for Trail Easement.
