easement, the City will assume responsibility for maintenance of the easement area. <br /> This project is proposing to construct a storm drain system for the benefit of this project <br /> and the project across the street known as DiDonato (now Kontech), a 13 lot <br /> subdivision(Tract 7968). Ponderosa Home is designing and installing said storm drain <br /> system with this tract. As per the Subdivision Map Act, Ponderosa Homes will be <br /> eligible for reimbursement of the pro-rata share with development of the project across <br /> the street. Enclosed is a draft copy of the reimbursement agreement for approval and <br /> execution by the City Manager. <br /> This 18" storm drain line within Stanley Boulevard will be accepted and maintained by <br /> the City with acceptance of other public improvements. <br /> Future Trail Connection <br /> A future trail extension is proposed that would extend the existing trail at Vervais <br /> Avenue and Main Street in an easterly direction along Arroyo Del Valle. The above <br /> mentioned trail easement is recommended for acceptance prior to construction of this <br /> trail. <br /> Discretion to Deny the Final Map <br /> The approval of a Final Map when the Final Map substantially complies with the <br /> conditions of the Tentative Map is a mandatory, ministerial act (Government Code, <br /> Section 66474.1). Put another way, a Final Map shall be disapproved only for failure to <br /> meet conditions that were applicable at the time the Tentative Map was approved.
