easement, the City will assume responsibility for maintenance of the easement area. This project is proposing to construct a storm drain system for the benefit of this project and the project across the street known as DiDonato (now Kontech), a 13 lot subdivision(Tract 7968). Ponderosa Home is designing and installing said storm drain system with this tract. As per the Subdivision Map Act, Ponderosa Homes will be eligible for reimbursement of the pro-rata share with development of the project across the street. Enclosed is a draft copy of the reimbursement agreement for approval and execution by the City Manager. This 18" storm drain line within Stanley Boulevard will be accepted and maintained by the City with acceptance of other public improvements. Future Trail Connection A future trail extension is proposed that would extend the existing trail at Vervais Avenue and Main Street in an easterly direction along Arroyo Del Valle. The above mentioned trail easement is recommended for acceptance prior to construction of this trail. Discretion to Deny the Final Map The approval of a Final Map when the Final Map substantially complies with the conditions of the Tentative Map is a mandatory, ministerial act (Government Code, Section 66474.1). Put another way, a Final Map shall be disapproved only for failure to meet conditions that were applicable at the time the Tentative Map was approved. If the Final Map is disapproved, there must be a finding identifying the conditions which were not met(Govemment Code, section 66473). Staff has reviewed the conditions of approval of the Tentative map, and finds that all have been satisfied and that the Final Map complies with the conditions of the Tentative Map.
