Under Section 7 of the Endangered Species Act(ESA),USACE must consult with the U.S. Fish <br /> and Wildlife Service(USFWS)if the proposed project has the potential to adversely affect a <br /> federally listed terrestrial species and non-anadromous fish. Federally listed terrestrial species <br /> and/or their habitats have some potential to occur within or near the project site Therefore,under <br /> Section 7 of the ESA,consultation between USACE and USFWS is expected to be required. <br /> This scope of work assumes that USACE or AECOM,under authorization from USACE and the <br /> City,will consult with USFWS and obtain authorization that satisfies compliance with the ESA. <br /> Please see Permitting Task 2 for further details. <br /> AECOM will prepare the NWP permit application on behalf of the City for submittal to USACE. <br /> The application would be required to include, but not be limited to,the following information <br /> that is assumed to be provided by other members of the,consultant team, City, or its designated <br /> representative: <br /> • amount(cubic yards) and type(i.e.,clean fill dirt,rock, clay, concrete)of material being <br /> placed within jurisdictional waters of the U.S.; <br /> • acreage of material dredged or excavated from jurisdictional waters of the U.S. (including <br /> temporary amount); <br /> • replacement quantities of native and imported material, and net permanent change(cubic <br /> yards); <br /> • identification and dimensions of structures and materials to be used in construction; <br /> • construction equipment and methods by which work will be done; <br /> • adjacent land owners; <br /> • written statement of how avoidance and minimization will be achieved for losses of <br /> waters of the U.S.; <br /> • methods of compensation for unavoidable fill of waters of the U.S.-; and <br /> • site plan identifying existing structures, work limits, and property boundary. <br /> AECOM will provide an electronic draft of the application package to the City for review, <br /> incorporate comments sent to AECOM, and submit final copies to USACE and the City. It is <br /> assumed that USACE will be given one copy of the application package and the City will receive <br /> two copies. <br /> It is assumed that one coordination meeting with USACE may be required and will be attended <br /> by the AECOM project manager and senior regulatory specialist to discuss project <br /> characteristics,permit requirements, and permitting schedules after submittal of the application. <br /> This is in addition to the pre-application meeting, which would be held to discuss project <br /> description and approach with USACE to determine if the project would be permitted under the <br /> NWP.Additional telephone/email coordination with USACE will also ensure that the permit <br /> application materials are technically accurate and meet the needs of USACE. <br /> The labor assumed to complete this task is based on current project knowledge and is reflected in <br /> the cost estimate. However, completion of the task is directly dependent on the participation and <br /> direction of regulatory agency staff,which is beyond the control of AECOM. AECOM will work <br /> 7IPage <br />
