EXHIBIT A <br /> AMENDMENT TO THE CONTRACT BETWEEN <br /> ALAMEDA COUNTY FLOOD CONTROL ANDWATER. <br /> CONSERVATION DISTRICT ZONE 7 AND CITY OF PLEASANTON <br /> This Amendment to the Contract between the Alameda County Flood Control.and Water <br /> Conservation District Zone 7(Zone 7) and the City of Pleasanton(City)is entered <br /> into 2014. <br /> WHEREAS,Zone 7 and City(as both the City of Pleasanton and as the successor to the <br /> Pleasanton Township County Water District)entered into a treated water supply contract dated <br /> March 12, 1968,as amended by the Amendment No. 1 dated March 16, 1971 (collectively the <br /> Contract); and <br /> WHEREAS,the Contract sets forth limitations on groundwater pumping for compliance <br /> with Water Rights Permit No. 11319; and <br /> WHEREAS,the Contract provides in Section B,Paragraph 3 that"the Independent Quota <br /> for the following year shall be reduced by the amount by which such production in the preceding <br /> year exceeded the Independent Quota";and <br /> WHEREAS,the Contract in Section B,Paragraph 4,provides for payment of a Recharge <br /> Fee by City to Zone 7 for independent water production in excess of Independent Quota; and <br /> WHEREAS,extreme dry conditions have persisted in California since 2012 such that <br /> Zone 7 has been notified by the State of California that water deliveries to Zone 7 will be <br /> significantly reduced,the State has declared a water emergency, and Zone 7 and City have each <br /> taken action to declare a water shortage and asked their respective water customers to reduce <br /> usage; and <br /> WHEREAS,Zone 7 wishes to produce,by all means available, as much water as <br /> possible; and <br /> WHEREAS,City has pumping capacity available over that necessary to pump its <br /> Independent Quota under said Contract. <br /> NOW THEREFORE,in exchange for mutual consideration,the receipt of which is <br /> hereby acknowledged,the parties agree as follows: <br /> 1. City's Independent Quota during the time of any water shortage declared by Zone 7 <br /> and the Pleasanton City Council shall not be reduced as a result of Pleasanton pumping in excess <br /> of its Independent Quota during the declared water shortage, as described in this Amendment. <br /> Page I.of 2 <br />
