RESOLUTION NO. 14-666 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON APPROVING AMENDMENT TO CONTRACT WITH ZONE 7 SUSPENDING INDEPENDENT QUOTA FOR GROUNDWATER PUMPING DURING DROUGHT WHEREAS, the Alameda Flood Control and Water Conservation District Zone 7 and the City entered into a water supply contract dated March 12, 1968 to set limits on groundwater pumping in compliance with State Water Rights Permit No. 11319; and WHEREAS, due to extremely dry conditions persisting since 2012, the City and Zone 7 need to utilize more groundwater since less surface water will be delivered by the State; and WHEREAS, the City and Zone 7 wish to amend the contract to suspend the independent quota on groundwater pumping and related recharge fees during the current drought. NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. The City Council approves the Amendment to the Contract between Alameda County Flood Control and Water Conservation District Zone 7 and the City of Pleasanton, in generally the form attached as Exhibit A, subject to modification by the City Manager in consultation with the Director of Operations Services. SECTION 2. The City Council authorizes the City Manager to execute the Amendment, subject to modification as described in Section 1, above. PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at a regular meeting held on March 18, 2014.
