(a) Five-AcreDensity Special Exemption. Single-family <br /> projects which have an average lot size of five (5) <br /> acres (gross) or more per lot shall qualify as <br /> specially exempt projects. <br /> <br /> (b) 20,000 Sq. Ft. Lot Special Exemption. Single-family <br /> projects which contain lots with a minimum lot size of <br /> 20,000 sq. ft. shall qualify as specially exempt projects <br /> subject to the limitations listed below: <br /> (1) The project site must be zoned R-I-20,000 District <br /> or another zoning classification requiring minimum <br /> lot sizes of at least 20,000 sq. ft. <br /> (2)A maximum of ten (10) may be built in any project <br /> in any calendar year. <br /> (3) A maximum of forty (40) units qualifying for this <br /> exemption may be built in the City in any calendar <br /> year; units shall be allocated on a first come, <br /> first served basis. <br /> <br /> (c) General Requirements. All projects qualifying for the <br /> special. exemption shall meet the following requirements: <br /> (1) The applicant shall pay the maximum contribution <br /> per lot to the Capital Improvement Fund, Housing <br /> Fund and any other incentive funds available in the <br /> Residential Allocation Program selection criteria <br /> in effect at the time of the application for exemption. <br /> (2) The proposal shall meet all of the mandatory elements <br /> of the Residential Allocation Program selection cri- <br /> teria in effect at the time of the application for <br /> exemption. Where any criterion cannot be applied at <br /> the subdivision level, the applicant for special <br /> exemption shall enter into an agreement that the <br /> houses to be built will be designed to meet those <br /> standards. <br /> (3)The proposal shall be consistent with the General <br /> Plan and conform to the existing zoning. <br /> <br /> (d) Procedure. Application to the City Council shall be made <br /> for approval of the exemption. The Council may deny or <br /> delay the project if it concludes that the project would <br /> have a negative impact on the Residential Allocation <br /> Program process or on the area of the City in which the <br /> proposal is made. <br /> <br />Section 9. That subsection (b) of Section 2-20.07 (Development <br />Approval for Exempt and Subsidized, Lower-Income Projects) is amended <br />as follows: <br /> <br /> (b) Subsidized, Lower-Income Projects. Application for use of <br /> the allocation for subsidized, lower-income housing develop- <br /> ments established under Section 2-20.06 (c) shall be made to <br /> the City Council for approval of the exemption. The Council <br /> may deny or delay the project if it concludes that the pro- <br /> ject would have a negative impact on the Residential Allocation <br /> Program or on the area of the City in which the proposal is <br /> made.
