(1) All existing City approval must have been obtained <br /> and the subsidizing agency must have approved funding_, <br /> for the project prior to application for use of this <br /> special allocation, <br /> (2) Application for use of this special allocation may <br /> occur at any time during the year. <br /> (3) In the event a proposed project contains more units <br /> than the yearly allocation for these projects estab- <br /> lished in Section 2-20.06(c) and as carried over in <br /> subsequent years pursuant to Section 2-20.12, the <br /> project sponsor may apply to the City Council for <br /> permission to develop a larger number of units than <br /> are presently available for subsidized, lower-income <br /> housing. <br /> (4) In the event that the City Council agrees to allow a <br /> development exceeding the subsidized, lower-income <br /> housing allocation, the allocation for this purpose <br /> at the subsequent year's allocation shall be appro- <br /> priately reduced. <br /> <br />Section 10. This ordinance shall become effective thirty (30) days <br />after the date of its final passage and adoption. <br /> <br />Section 11~ This ordinance shall be published once within fifteen (15) <br />days after its adoption in "THE TIMES," a newspaper of general circula- <br />tion, published in the City of Pleasanton. <br /> <br />Section 12. Severability. If any section, subsection, sentence, '- <br />clause, phrase or portion of this code is for any reason held to be <br />invalid or unconstitutional by the decision of any court of competent <br />jurisdiction, such decision shall not affect the validity of the re- <br />maining portions of this code.
