Ruby Hill; and (vii) City of Pleasanton City Council approval of Tract 6452 Signature <br /> Properties (Ruby Hill)on April 7, 1992 (collectively the"Ruby Hill Development <br /> Regulations"). <br /> D. The Ruby Hill development's CC&Rs provide for a Ruby Hill Owners' <br /> Association, which maintains common areas within the development and enforces many <br /> of the Ruby Hill Development Regulations within the community, including administering <br /> an Architectural Design Committee that reviews and approves, disapproves or <br /> conditionally approves all requests for design and construction of a residence in the <br /> Ruby Hill development as provided in Article XI of the CC&Rs. <br /> E. The Reddys hired a draftsperson by the name of Tim Pfuhl, of Payton, Utah, to <br /> prepare the design and construction drawings of the residence for their Property. The <br /> Reddys submitted said drawings to the Ruby Hill Architectural Design Committee, as <br /> required by the CC&Rs. <br /> F. The Architectural Design Committee conditionally approved the Reddy's design <br /> for their residence on or about June 2010, excepting from that approval the exterior <br /> color, material, and landscaping, which was to be subject to submission to the <br /> Architectural Design Committee for its review and approval. <br /> G. The Architectural Design Committee approved the exterior of the residence, as <br /> set forth in a letter dated June 30, 2010. <br /> H. After receiving approval of the design of the Reddy residence, Mr. Anil Reddy <br /> has acted as the owner-builder for construction of his residence. <br /> I. The City issued Mr. Reddy a building permit RES2 200581 on November 19, <br /> 2010, which was replaced by Permit No. B12-1990 issued on September 6, 2012, after <br /> its expiration. The said permits allowed for construction of the Reddy residence. The <br /> design submitted for the building permit is on file in the City of Pleasanton's Building <br /> Division, located at 200 Old Bemal Avenue, Pleasanton, California, and is incorporated <br /> herein by this reference. <br /> J. Mr. Reddy has alleged that during the course of construction of the Reddy <br /> residence, Mr. Terry Townsend, an architect and consultant for the Ruby Hill Owners' <br /> Association Architectural Design Committee, provided on-site approvals for <br /> modifications to the design of the Reddy residence which deviated from the design that <br /> the Architectural Design Committee approved. <br /> 2 <br />
