Box 520 <br /> Pleasanton,CA 94566-0802 <br /> Recording requested puhsuant to <br /> Govt.Code§§27383&6103 <br /> Temporary Certificate of Occupancy Agreement <br /> This Temporary Certificate of Occupancy Agreement(the "Agreement") is <br /> entered into June 28, 2013, by and between the City of Pleasanton, a municipal <br /> corporation (the "City"), and Anil Reddy and Divya Reddy(collectively, the "Reddys"). <br /> Recitals <br /> A. The Reddys own real property commonly known as 3737 West Ruby Hill Drive, <br /> Pleasanton, California, as described more particularly in the attached Exhibit A (the <br /> "Property"). <br /> B. The Property is located within the Ruby Hill development, an approximately <br /> 1,403.acre master planned golf course community, of which 1,170 acres are annexed <br /> into the City. <br /> C. Within the Ruby Hill development, the planned 850 housing units are subject to <br /> extensive regulations, including, but not limited to: (I) Ordinance No. 0-91-18, adopted <br /> by the Board of Supervisors of Alameda County on June 6, 1991, approving a rezoning <br /> of a portion of the Ruby Hill development to Planned Development, 1837th Planning <br /> Unit; (ii) Ordinance No. 0-91-989, adopted by the Board of Supervisors of Alameda <br /> County on December 5, 1991, approving a rezoning of a portion of the Ruby Hill <br /> development to Planned Development, 1949th Planning Unit; (iii) Resolution No. 92-16, <br /> adopted by Alameda County on October 7, 1992, approving Tentative Map 6452; (iv) <br /> the Declaration of Covenants, Conditions and Restrictions of Ruby Hill, recorded in the <br /> Alameda County Recorder's Office as Record No.: 94-082427 and as amended by the <br /> First Amendment recorded in the Alameda County Recorder's Office as Record No.: 94- <br /> 143694(collectively, the "CC&Rs"); (v) Design Review Guidelines, dated October 1992, <br /> updated June 1994& September 1995 &January 2000; (vi) City of Pleasanton <br /> Ordinance No. 1551, adopted April 7, 1992, approving Pre-Zoning of 1,170 acres of <br /> 1 <br />
