10. ~mt a lot specific geologic investigation shall be undertaken for each lot where <br /> structures are planned within 30 ft. of a slope where the m~tural grade exceeded <br /> 15% for any lot which is on fill; and for any other lot where such an investigation <br /> is deemed necessary by the Chief Building Inspector or City Engineer; these investi- <br /> gations shall certify the existence of a building site on each lot examined. Inves- <br /> tigation shall be done by a state licensed geologist or geologic engineer and shall be <br /> completed prior to filing a final map on the subject property. <br /> <br />11. That should any proposed lot not prove to be buildable, such lot shall not be shown <br /> on the tentative map as a separate parcel, but shall be included in the open space <br /> lands or added to neighboring parcels. <br /> <br />12. That Pico Avenue shall be constructed at least as a half-street from Sunol Boulevard <br /> to the easternmost north/south street as part of the first phase of this development <br /> and that the developer be aware that the exact design details of the roads and all <br /> utilities will be determined at the tin~ of the consideration of the tentative and <br /> final subdivision maps for the project. If the first phase is for 60 or less lots <br /> and none of those lots require access conjunction with the development phase.which <br /> contains the 61st lot. <br /> <br /> 13. That appropriate soils investigations and reports shall be completed by a state <br /> licensed geologist or geologic engineer or a soils engineer and approved by the <br /> Building Division prior to iss~qnce of a building permit. Both the soils reports <br /> and geologic report mentioned in number 10 above shall be used to govern how the <br /> structures will be built on the site. <br /> <br /> 14. That the geologic investigation and soils reports mentioned in conditions 10 and 13 <br /> above shall be recorded with the Alameda County Recorder against each parcel. <br /> <br /> 15. That the maintenance of all open space areas shown on the plan shall be the responsi- <br /> bility of a homeowners association comprised of all property owners within the subject <br /> area; that these areas shall be maintained at all times to the satisfaction of the <br /> Fire Chief; and that all landscaping in these areas shall be of a fire retardent <br /> nature. <br /> <br /> 16. That prior to the filing of a final map, the CC&Rs for the project shall be approved <br /> by the City Attorney. The CC&Rs shall provide for a homeowners association with <br /> sufficient power to nmnage all conmon open space areas. The CC&Rs shall provide <br /> that the City be granted an irrevocable right of entry for public safety and n~nicipal <br /> purposes, and that the City shall be named as beneficiary of said CC&Rs and granted <br /> the power to enforce its provisions if the homeowners association fails to do so. <br /> <br /> 17. That all utilities required to serve the development be installed underground. <br /> <br /> 18. That the developer install street trees as required per ordinance. <br /> <br /> 19. That any danage done to street improven~nts now existing or done during construction <br /> on the subject property be repaired at full expense to the developer. <br /> <br /> 20. That the site be kept free of fire hazards from the start of construction to final <br /> inspection, and that the Fire Departn~nt emergency number be provided adjacent to <br /> all telephones on the site. <br /> <br /> <br />
