(q) "Construction Documents" shall mean the Construction plans, budgets, <br /> schedules and a construction contract prepared by the Developer. <br /> (r) "Construction Phasing Plan" shall mean the plan to construct the Phases of <br /> the Development, attached to this Agreement as Exhibit A-2. <br /> (s) "Construction Plans" shall mean all construction documentation upon <br /> which Developer and Developer's contractors shall rely in constructing the applicable Phases <br /> (including landscaping, parking, common and public areas) and shall include, without limitation, <br /> final architectural drawings, the site development plan, landscaping plans and specifications, <br /> final elevations, and building plans and specifications. <br /> (t) "County" shall mean the County of Alameda, a political subdivision of the <br /> State of California, having its offices at 1221 Oak Street, Oakland, CA 94612. <br /> (u) "County HOME Loan" shall mean a HOME Loan from the County of <br /> Alameda. <br /> (v) "Council" shall mean the City Council of the City of Pleasanton. <br /> (w) "Days" shall mean calendar days and the statement of any time period <br /> herein shall be calendar days, and not business days, unless otherwise specified. <br /> (x) "Developer" shall mean MidPen Housing Corporation, a nonprofit public <br /> benefit corporation and its successors and assigns. <br /> (y) "Development" shall have the meaning ascribed in paragraph A of Article <br /> 1. <br /> (z) "Effective Date" shall mean the date first set forth above. <br /> (aa) "ENRA" shall have the meaning ascribed in paragraph C of Article 1. <br /> (bb) "Escrow" shall have the meaning ascribed in Section 8.3. <br /> (cc) "Escrow Agent" shall have the meaning ascribed in Section 8.3. <br /> (dd) "Financing Plan" shall have the meaning ascribed in Section 5.1. <br /> (ee) "HACA" shall mean the Housing Authority of Alameda County, a public <br /> body corporate and politic organized under the laws of California, having its offices at 22941 <br /> Atherton Street Hayward, CA 94541. <br /> (ff) "Hazardous Materials" shall mean: (i) any substance, material, or waste <br /> that is petroleum, petroleum-related, or a petroleum by-product, asbestos or asbestos-containing <br /> material, polychlorinated biphenyls, flammable, explosive, radioactive, freon gas, radon, or a <br /> pesticide, herbicide, or any other agricultural chemical, and (ii) any waste, substance or material <br /> defined as or included in the definition of"hazardous substances," "hazardous wastes," <br /> 5 <br /> 191\52\1242198 13 <br />
