satisfaction, this development plan approval would be void and an <br />application for a new PUD development plan would need to be submitted. <br /> <br />o <br /> <br />The uses of each of the lots shall be limited to those of the R-1 zoning <br />district. <br /> <br />The developer ac'knowledges that the City, of Pleasanton does not guarantee <br />the availability of sufficient sewer capacity to serve this development by the <br />approval of this case, and that the developer agrees and ac'knowledges that <br />building permit approval may be withheld if sewer capacit3~ is found by the <br />City not to be available. <br /> <br />10. <br /> <br />This approval does not guarantee the availability of sufficient water to serve <br />the project. The City shall withhold building permits for the project if at the <br />time building permits are applied for, mandatory water rationing is in effect, <br />unless the City has adopted a water offset program and unless the developer <br />is participating in the program. Notwithstanding the developer's participation <br />in such a program, the City may withhold building permits if the City <br />determines that sufficient water is not available at the time of application of <br />building permits. <br /> <br />11. In order to effectuate the subdivision of the property, the applicant shall <br /> submit an application for a subdivision map for approval by the City. <br /> <br />12. <br /> <br />Development on Lots 1 to 4 shall be subject to the development standards of <br />the R-1-20,000 zoning district as modified by the approved design <br />guidelines. Development on Lot 5 shall be subject to the development <br />standards of the R-I-40,000 zoning district except as modified by the <br />approved design guidelines. <br /> <br />13. <br /> <br />The homes on lots 3, 4, and 5 shall be limited to single story homes with a <br />maximum height of 22 fi. as measured from the lowest grade to the highest <br />peak. A deed disclosure and a separately recorded restrictive covenant <br />subject to review and approval by the City Attorney shall be recorded <br />identifying the height restriction for these lots. <br /> <br />14. The applicants shall obtain applicable City permits for the project prior to the <br /> commencement of construction. <br /> <br />15. <br /> <br />The applicant shall provide all buyers with copies of the project .conditions of <br />approval and design guidelines. Reference to the conditions and design <br />guidelines Shall be made in a deed disclosure and a separately recorded <br />restrictive covenant, subject to the review and approval of the City Attorney. <br /> <br /> <br />
