EXHIBIT "B" <br />CONDITIONS OF APPROVAL <br />CASE PUD-22 <br /> <br />Planning <br /> <br />The proposed development shall conform substantially to the development <br />plan and design guidelines/development standards Exhibit A. dated <br />"Received May 6. 2003", on file with the Planning Department, except as <br />modified by these conditions. Minor changes to the plans may be allowed <br />subject to the approval of the Planning Director if found to be in substantial <br />conformance with the approved exhibits. <br /> <br />The development plan shall be of no further validity and the project developer <br />shall be required to submit the same or new development plan for City <br />approval prior to development of the site in the event that the project <br />developer fails to record a final map within two (2) years of PUD approval. <br /> <br />o <br /> <br />Prior to recordation of the parcel map, the developer shall pay all required fees <br />applicable to this property contained in the North Sycamore Specific Plan <br />Finance Plan. <br /> <br />o <br /> <br />Prior to building permit issuance, the homebuilder shall show evidence of <br />payment of the Pleasanton Unified School District school impact fee that is <br />in existence at the time of issuance of a building permit. <br /> <br />Unless otherwise required, the developer shall pay the in-lieu park dedication <br />fees prior to recordation of the final map. <br /> <br />Unless otherwise approved by the Planning Director, the new lots shall <br />become part of the North Sycamore Specific Plan Maintenance Association <br />or the Sycamore Heights Property Owners Association, and the property <br />owners shall pay their pro-rata share of maintenance cost for the shared <br />improvements. The Planning Director shall have the discretion of <br />determining which association is applicable. <br /> <br />In the event that the adjacent Sycamore Heights project is not under <br />construction prior to recordation of the final map for the project, the <br />developer shall be required to demonstrate to the Planning Director and the <br />City Engineer how Sunset Creek Lane improvements, utilities, street <br />landscaping would be provided for by this project. In the event that these <br />issues cannot be addressed to the Planning Director's and the City Engineer's <br /> <br /> <br />
