42.Unless otherwise shown on the approved PUD landscape plan, all trees used in <br /> landscaping be a minimum of 24" box in size and all shrubs a minimum of five (5) <br /> gallons. <br /> 43.The State of California's Green Building Standards Code, "CALGreen," shall apply, <br /> if applicable. <br /> 44.Water conservation devices shall be installed as part of the proposed project. The <br /> water conservation devices shall be stated on the plans submitted for the issuance <br /> of a building permit. <br /> 45.Energy Star appliances shall be installed in each apartment unit if available. The <br /> proposed appliances shall be stated on the plans submitted for the issuance of a <br /> building permit. <br /> 46.Each residential unit shall be sub-metered for sewer and/or water billing purposes. <br /> 47.Developer acknowledges and has demonstrated to the City that the affordable units <br /> provided for in the Affordable Housing Agreement are not subject to the Costa <br /> Hawkins Rental Housing Act under the exception provided in Civil Code section <br /> 1954.50 and based upon the parties negotiating and entering into an Affordable <br /> Housing Agreement. Through this Affordable Housing Agreerent and City's <br /> concurrent approval of Developer's project, Developer is receiving valuable <br /> consideration from City, namely the rights and entitlements conferred by such <br /> project approval and the Affordable Housing Agreement. <br /> 48.The applicant/developer shall provide two electric vehicle charging stations in the <br /> tenant parking area. The charging stations shall be shown on the plans submitted <br /> to the Building and Safety Division for plan check and shall be subject to the review <br /> and approval of the Director of Community Development prior to building permit <br /> issuance. <br /> 49.The applicant/project developer shall install onsite electrical generation in the <br /> community/leasing center building to provide sufficient electrical power for the <br /> community's site lighting. <br /> 50.The applicant/project developer shall develop and implement measures that will <br /> achieve 25 percent better energy efficiency for the project over that required by T- <br /> 24. The method used and plan details shall be subject to the review and approval <br /> of the Director of Community Development prior to building permit issuance. <br /> 51.The applicant/project developer shall incorporate solar tubes, skylights, and/or other <br /> daylighting systems, subject to the satisfaction of the Director of Community <br /> PUD-81-30-87D, Anton Hacienda Apartments May 21, 2013 <br /> Page 9 of 33 <br />
