City Traffic Engineer Mike Tassano said the intersection was evaluated as part of the traffic study and <br /> that current or projected volumes do not warrant installation of a signal. He estimated that a signal <br /> would likely result in longer delays as well as the increase in collisions that is inherent with any signal. <br /> He said staff does not recommend it at this time but will continue to monitor the area. <br /> Vice-Mayor Cook-Kallio asked and Mr. Tassano confirmed that the third access point to the <br /> development would help to mitigate traffic further. With regard to the overall project, she said she could <br /> support the variances but would like to see more specific commitments regarding educational services. <br /> Councilmember Pentin said all of his questions had been asked to and answered by the applicant. <br /> Councilmember Narum asked Mr. Tassano what mitigation measures would be available if there were <br /> to be issues during peak traffic hours. <br /> Mr. Tassano reiterated that he did not anticipate an issue but said that anything designed to reduce the <br /> number of conflict movements such as peak hour restrictions, lane modifications or a traffic signal <br /> would be an option. <br /> Mayor Thorne asked staff to comment on the subsidence issue. <br /> Mr. Dolan explained that a geotechnical study was incorporated into the environmental review <br /> documents and does recommend specific mitigations for the site. There is also an opportunity, if the <br /> Building Official feels it appropriate, for additional exploration of mitigations as part of the building <br /> permit process. He stressed that it is not in anyone's interest to avoid the issue, particularly in a <br /> situation where the developer intends to retain ownership of the property. <br /> Mayor Thorne closed the public hearing. <br /> Councilmember Pentin asked if the Council had the ability to condition the 3 fully accessible units to <br /> remain as such in perpetuity. <br /> Mr. Dolan explained that they are inherently required to remain fully accessible. <br /> Acknowledging Councilmember Pentin's concern, Mr. Zahedani said they would agree to proactive <br /> marketing and any other recommendations but would not want the unit to remain vacant if, despite best <br /> efforts, they were unable to identify an appropriate tenant. <br /> Mr. Fialho suggested they extend the open market waiting period from 10 to 21 days. <br /> Councilmember Pentin said he could support that. He asked what role the City has in the application or <br /> any subsequent agreement between the applicant and California Statewide Communities Development <br /> Authority. <br /> Mr. Fialho explained that the application is for bond financing through the state. The bond counsel will <br /> be involved in the terms and conditions of its implementation and various state agencies will be <br /> responsible for monitoring regulatory requirements. The City has no role here unless the Council was to <br /> support the Vice-Mayor's request to make available a physical space or other educational support <br /> beyond that provided for in the application. <br /> Councilmember Pentin asked and Mr. Dolan confirmed that allowing construction Monday through <br /> Saturday is a standard condition.
