ARTICLE 1. General

<br />1.105.16.
<br /> a. Use, accessory. A use which is appropriate, subordinate, and
<br /> customarily incidental to the main use of the site and which is
<br /> located on the same site as the main use.
<br /> b. Usable open space. Open space meeting the requirements of
<br /> Sec. 2.110, Usable Open Space.
<br /> e. Width. The horizontal distance between the side property lines
<br /> of a site measured at right angles to the depth at a point mid-
<br /> way between the front and rear property lines.
<br /> d. Yard. Am open space on the same site as a structure, unoccu-
<br /> pied and unobstructed by structures from the ground upward
<br /> or from the floor level of the structure requiring the yard up-
<br /> ward except as otherwise provided in this ordinance, including
<br /> a front yard, side yard, rear yard, or space between structures.
<br /> e. Yar~, front. A yard extending across the full width of a site,
<br /> the depth of which is the minimum horizontal distance between
<br /> the front property line and a line parallel thereto on the site.

<br />1.105.17.
<br /> a. Yard, rear. A yard extending across the full width of a site, the
<br /> depth of which is the minimum horizontal distance between
<br /> the rear property line and a line parallel thereto on the site.
<br /> b. Yard, side, A yard extending from the rear line of the required
<br /> front yard, er the front property line of the site where no front
<br /> yard is required, to the front line of the required rear yard, or
<br /> the rear property line of the site where no rear yard is re-
<br /> quired, the width of which is the minimum horizontal distance
<br /> between the side property line and a line parallel thereto on
<br /> the site.

<br /> I Industrial Districts

<br /> RO Residential Overlay District
<br /> PUD Planned Unit Development District. Any use permitted
<br /> by this ordinance may be approved.
<br /> CO Civic Overlay District
<br />
<br /> Sec. 1.107. District Boundaries
<br /> Wherever any uncertainty exists as to the boundary of a district
<br />
<br />as shown on the zoning map, the following regulations shall control:
<br />a. Where a boundary line is indicated as following a street or
<br />alley, it shall be construed as following the right of way line
<br />thereof.
<br /> b. Where a boundary line is indicated as following a watercourse,
<br /> it shall be construed as following the center line thereof.
<br /> c. Where a boundary line follows or coincides approximately with
<br /> a lot line or a property ownership line, it shall be construed as
<br /> following the lot line or property ownership line.
<br /> d. Where a boundary line is not dimensioned and is not indicated
<br /> as following a street or alley an,d does not follow or coincide
<br /> approximately with a lot line or property ,ownership line, the
<br /> boundary line shall be determined by the use of the scale des-
<br /> ignated on the zoning map.
<br /> e. Where further uncertainty exists, the City Planning Commis-
<br /> sion, upon written application or on its own motion, shall de-
<br /> termine the location of the bundary in question, giving due
<br /> consideration to the location indicated on the zoning map and
<br /> the objectives of the zoning ordinance and the purposes set
<br /> forth in the district regulations.
<br />
<br />Sec. 1.108. Conformity Required.
<br /> a. No site or structure shall be used or designated for use for any
<br /> purpose or in any manner other than in conformity with the
<br /> regulations for the district in which the site or structure is
<br /> located.
<br /> b. No structure shall be erected and no existing structure or use
<br /> shall be moved, altered, or enlarged except in conformity with
<br /> the regulations for the district in which the structure or use
<br /> is located.
<br /> c. No yard space provided in compliance with the regulations for
<br /> the district in which it is located shall be deemed to provide
<br /> a yard space for any other structure, and no yard or usable
<br /> open space on one site shall be deemed to provide a yard space
<br /> or usable open space for a structure on any other site.
<br /> d. No yard, court, or usable open space shall be used, encroached
<br /> upon, or reduced in any manner except in conformity with the
<br /> regulations for the district in which the yard, court, or ope~
<br /> space is located.
<br /> e. No site held in one ownership at the time of the adoption ot
<br /> this ordinance or at any time thereafter shall be reduced in an~
<br /> manner below the minimum area, frontage, width, or depth pre
<br /> scribed for the district in which the site is located.
<br />
<br /> Sec. 1.109. Public Hearing Time a~d Notice.
<br />The Zoning Administrator shall set the time and place of publi(
<br />hearings required by this ordinance to be held by the City Plannin~
<br />Commission, or the Board of Adjustment, provided that the Corn
<br />mission or the Board may change the time or place of a hearing
<br />The City Clerk shall set the time and place of public hearings re
<br />quired by this ordinance to be held by the City Council, providei
<br />that the Council may change the time or place of a hearing. Publh
<br />hearings shall be held not moro than 40 days after submissim
<br />o£ the application or the appeal from a decision unless the applican
<br />or appellant shall consent to an extension of time. Notice of a pub
<br />lic hearing shall be given not less than 10 .days nor more than 3(
<br />days prior to the date of the hearing by publication in a newspape~
<br />of general circulation in the City of Pleasanton. When the hearin~
<br />concerns a matter other than an amendment to the text of this ordi
<br />nance or a General Plan amendment, notice also shall be given b.~
<br />posting in conspicuous places close to the property affected or b;
<br />mailing a notice of the time and place of the hearing to the appli
<br />cant, if any, and to ail persons whose names appear on the lates
<br />a'dopted tax roll of Alameda County as owning property in the vici
<br />nity of the area that is the subject of the hearing. The zoning Ad
<br />mlnistrator shall determine the number and location of posted no
<br />tices or the area within which property owners are to be notifiel
<br />by mail. Failure to post or mail notices shall not invalidate th,
<br />proceedings.
<br />
<br /> Sec. 1.110. City Council Review
<br /> Within 15 days following a decision of the Planning Commissio~
<br /> or the Board of Adjustment on a matter on which a public hearin~
<br /> is required by this ordinance, or at its next regular meeting, whic~
<br /> ever is later, the City Council may elect to review the action of th,
<br /> Commission or the Board of Adjustment. If the Council elects t,
<br /> review aN action and declines to confirm the decision, a publi,
<br /> hearing shall be held by the Council. The hearing shall be set an,
<br /> notice given as prescribed in Sec. 1.109.
