ARTICLE 1. General

<br /> used motor vehicles which are not capable of operating under
<br /> their own power shall constitute prima facie evidence of a motor
<br /> vehicle wrecking yard.
<br /> b. Multi-family dwelling. A structure containing more than one
<br /> dwelling unit, designed for occupancy or occupied by more than
<br /> one family.
<br /> c. Non.conforming sign. A sign, outdoor a'dvertising structt'~re, or
<br /> display of any character, which was lawfully erected or dis-
<br /> played, but which does not conform with standards for location,
<br /> size, or illurdinatien for the district in which it is located by
<br /> reason of adoption or amendment of this ordinance, or by rea-
<br /> son of annexation of territory to the City.
<br /> d. Non-conforming structure. A structure which was lawfully
<br /> erected, but which does net conform with the st2ndards for
<br /> yard spaces, height of structures, or distances between struc-
<br /> tures prescribed in the regulations for the district in which the
<br /> structure is Iocated, by reason of adoption or amendment of
<br /> this ordinance, or by reason of annexation ef territory to the
<br /> City.
<br /> e. Non-conforming use. A use of a structure or land which was
<br /> lawfully established and maintained, but which does not con-
<br /> form with the use regulations or required conditions for the
<br /> district in which it is located, by reason of adoption or amend-
<br /> ment of this ordinance, or by reason of annexation of territory
<br /> to the City.

<br />1.105.11.
<br /> a. Nurser~ school. A school for five or more pre-elementary
<br /> school age children, or use of a site or portion of a site for a
<br /> group day-care program for five or mere chil~lren other than
<br /> those resident on the site, including a day nursery, play group,
<br /> or after-school group.
<br /> b. Nursing home. A structure operated as a lodging house in which
<br /> nursing, dietary, and other personal services are rendered to
<br /> convalescents, invalids, or aged persons, not including persons
<br /> suffering from contagious or mental diseases, alcoholism, or
<br /> drug addiction, and in which surgery is not performed and pri-
<br /> mary treatment, such as customarily is given in hospitals or
<br /> sanitariums, is not provided. A convalescent home or a rest
<br /> home shall be deemed a nursing home.
<br /> c. Off-street inading facilities. A site or portion of a site devoted
<br /> to the loading or unloading of motor vehicles or trailers, in-
<br /> cluding loading berths, aisles, access drives, and landscaped
<br /> areas.
<br /> d. Off~Street parking facilities. A site or port~on of a site devoted
<br /> to the off-street parking of motor vehicles, including parking
<br /> spaces, aisles, access drives, and landscaped areas.
<br /> e. Oriel window. A window which projects from the main line of
<br /> an enclosing wall of a building and is carried on brackets or
<br /> corbels.

<br /> a. Outdoor advertising structure. A structure of any kind or char-
<br /> acter erected or maintained for outdoor advertising purposes,
<br /> upon which any advertising sign may be placed.
<br /> b. Patio, covered. An attached or detached structure not exceed-
<br /> lng 14 feet in height, and enclosed on not more than three sides
<br /> except for posts necessary for roof support.
<br /> c. Pre-existing. In existence prior to the effective date oi this
<br /> ordinance.
<br /> ~l. Railroad right of way. A strip of land on which railroad tracks,
<br /> switching equipment, and signals are 1neared, but not including
<br /> lands on which stations, offices, storage buildings, spur tracks,
<br /> sidings, yards, or other uses are located.
<br /> e. Service Station. A place where gasoline or any other motor
<br /> fuel, lubricating oil, or grease for the operation of motor ve-
<br /> hicles is ,offered for sale to the public and deliveries are made
<br /> directly into the vehicle, including sale of accessories, perform-
<br /> ance of minor repairs and lubrication, and the washing of au-
<br /> tomobiles where no chain conveyor or blower is used.
<br />1.105.13.
<br /> a. Sign. Any lettering or symbol made of c~oth, metal, paint, paper,
<br /> wood, or other material of any kind whatsoever placed ~or ad-
<br /> vertising, identification, or other purposes on the ground or on
<br /> any bush, tree, rock, wall, post, fence, building, structure, ve-
<br /> hicle, or on any place whatsoever. The term "placed" shall in-
<br /> clude constructing, erecting, posting, painting, printing, tacking,
<br /> nailing, gluing, sticking, carving, or otherwise fastening, affix-
<br /> ing, or making visible in any manner whatsoever beyond 'the
<br /> boundaries of a site.
<br />
<br /> b. Sign area. The area of a sign shall be computed as the enti~
<br /> area within a single continuous rectilinear perimeter of not
<br /> more than eight straight lines enclosing the extreme limits o~
<br /> writing, representation, emblem, or design, together with any
<br /> material or color forming an integral part ef the display or used
<br /> to differentiate the sign from the background against which it
<br /> is placed. Sign supports shall not be included in determining
<br /> sign area unless they are an integral part of the display. Tho
<br /> area nfa sign or the total area of all signs on a site shah be
<br /> the total area that would be visible, whether legible or not, to ar~
<br /> off-site observer having an unobstructed view of the site from
<br /> any single point within a horizontal distance of 100 feet from
<br /> the site boundary at an elevation not more than 100 feet above
<br /> the site boundary.
<br /> c. Sign, subdivision. Any sign located either on or off a subdivi-
<br /> sion tract, which indicates the direction to or advertises the lo-
<br /> cation, existence, er sale of a subdivision or any part thereof.
<br /> d. Single ownership. Holding record title, possession under a con-
<br /> tract to purchase, or possession under a lease, by a person,
<br /> firm, corporation, or partnership, individually, jointly, in com-
<br /> mon, or in any other manner whereby the property is or will
<br /> be under unitary or unified control.
<br /> e. Site or lot. A parcel of land or a portion thereof, considered as
<br /> a unit, devoted to or intended for a use or occupied by a struc-
<br /> ture or a group of structures that are united by a common in.
<br /> terest or use. A site or lot shall have frontage on a street.

<br />1.105.14.
<br /> a. Site area. "The total horizontal area included within the prop.
<br /> erty lines of a site. exclusive of the area of access corridors~
<br /> streets, portions of the site within future street plan lines. Pro.
<br /> vided however, all lots in subdivisions with acute angles less
<br /> than 45~ formed by adjacent sides shall be discouraged by th(
<br /> Planning Commission at the time of Tentative ~Map Approval.'
<br /> b. Street. A thoroughfare right of way, dedicated as such or ac
<br /> quired for public use as such, other than an alley, which affords,
<br /> the principal means of access to abutting land.
<br /> c. Structure. Anything constructed or erected which requires a lo
<br /> cation on the ground, including a building or a swimming pool
<br /> but not including a fence or a wall used as a fence if the heigh~
<br /> does not exceed six feet, or access drives or walks.
<br /> d. Structure, accessory Class I. A subordinate structure, the us(
<br /> of which is appropriate, subordinate, and customarily inciden
<br /> tel to that of the main structure or the main use of the land
<br /> and which is located on the same site with the main structur~
<br /> or use. Class I accessory structures shall include those accessor~
<br /> structures designed for possible habitation and include covere~
<br /> patios, garages and carports, any covered or enclosed area witt
<br /> a height greater than 6 feet and an area greater than 80 squar~
<br /> feet.
<br /> e. Structure, accessory Class II. A subordinate structure, the usc
<br /> of which is appropriate, subordinate and customarily incidental
<br /> to that of the main structure or Class I accessory structure, al
<br /> the main use of the land, and which is located on the sam(
<br /> site with the main structure or use. Class II accessory structure~
<br /> shall include those accessory structures nat designed for habi
<br /> ration, and include plant shelters an.d lath area and tool storag(
<br /> sheds with a height no greater than 6 feet and an area no great
<br /> er than 80 square feet.
<br /> f. Structure, main. A structure housing the principal use of a sit(
<br /> ~r functioning as the principal use.

<br />1.105.15.
<br /> a. Swimming pool. A pool, pond, lake, or open tank capable of con
<br /> raining water to a depth greater than one and one-half feet W
<br /> any point.
<br /> b. Trailer. A mobile home or similar portable structure having ne
<br /> foundation other than wheels, jacks, or skirtings, and, so designe~
<br /> or constructed as to permit occupancy for dwelling or sleepin~
<br /> purposes.
<br /> c. Trailer p~rk. A site or portion of a site which is used or in
<br /> tended to be used by persons living in trailers or mobile home~
<br /> on a permanent or transient basis.
<br /> d. Trausminsinn lines. An electric power line bringing power to ~
<br /> receiving substation or a ~listribution substation.
<br /> e. Use. The purpose for which a site or structure is arranged, de
<br /> signed, intended, constructed, erected, moved, altered, or en
<br /> larged or for which either a site or a structure is or may b~
<br /> occupied or maintained.
