ARTICLE 1. General Sec. 1.111. Appeal to Board of Adjustment, City Planning Commission, or City Council Where this ordinance provides for an appeal o£ a decision by the Zoning Administrator, the Building Inspectnr, the Board of Adjust- ment, the Board of Design Review, or the City Planning C~mmission, the appeal shall be filed within 15 days of the date of the decision being appealed and shall be filed with the Secretary in the case of an appeal to the Board of Adjustment or the Commission and with the City Clerk in the ease of an appeal to the City Council. The appeal shall be made on a fi)tm approved by the Commission and shall state specifically wherein it is claimed there was an error or abuse of discretion by the perso~ or body making the decision or wherein a decision following a public hearing is not supported by the evidence in the record. Sec. 1.112. Pubile Hearing on Appeal. The body designated by this ordinance to hear an appeal shall hol~ at least one public bearing within 40 days o£ the date when th. appeal was filed. The hearing shall be set and notice given as pre scribed in Sec. 1.109. Sec. 1.113. Action on Appeal. Within 40 days following the closing of a public hearing on an ar peal, the body hearing the appeal shall render its decision. A dec: sion by the Board ~)f Adjustment or the Planning Commission sha] become final 15 days after it is made, unless appealed, and a d~( cision by the City Council shall be final immediately after it i made. If an appealed decision is reversed or modified, the hod: hearing the appeal shall, on the basis ~)f the record transmitted an, such additional evidence as may be submitted, make the finding required by this ordinance as prerequisite to granting the applic~ tion or shall specifically decline to make such findings.
