merit plan approvals must have been received and the <br /> appeal period lapsed, or if appealed, a decision <br /> in favor of the project must have been rendered. <br /> <br /> (2) If the project involves regular zoning (R-1-6500, <br /> etc.), requiring only approval of tentative and <br /> final maps, the environmental assessment must be <br /> completed and the preliminary plan and all other <br /> required information must be submitted. <br /> <br /> (3) If the project only requires Design Review approval, <br /> it must have received all of said approvals, the <br /> appeal period must have lapsed, or if appealed, a <br /> decision in favor of the project must have been <br /> rendered. <br /> <br /> (4) If a project consists of development on lots in <br /> a previously approved final tract containing five <br /> (5) or more vacant lots, it shall be required to re- <br /> ceive Residential Allocation Program approval; such <br /> undeveloped, final tracts are projects which have <br /> received sufficient governmental approvals to be <br /> considered in the Residential Allocation Program. <br /> <br /> (b) Size of Projects. No project proposed for Residential <br /> Allocation Program review may contain more than eighty (80) units. If <br /> a proposed development would contain more than eighty units, the entire <br /> development should be shown with the first phase (eighty units or fewer) <br /> desired to be judged by the City Council indicated. In addition, a <br /> single developer may receive development approval for a maximum of <br /> eighty (80) units in any one allocation period, which may be in one or <br /> more developments. A single developer may apply for an unlimited number <br /> of units; should more than eighty units qualify for development, the <br /> developer may choose which of his proposals he wishes to develop, sub- <br /> ject to the eighty unit maximum. <br /> <br /> Section 2-30.09. Application. An application on a form estab- <br />lished by the Planning Division of the Department of Community Develop- <br />ment and containing that information necessary to properly administer <br />the Residential Allocation Program shall be filed with the Director of <br />Planning and Community Development. The application shall be accompanied <br />by a fee established by the resolution establishing fees and charges <br />for various municipal services and must be submitted no later than 30 <br />days prior to the scheduled meeting to select projects for development. <br /> <br /> Section 2-20.10. Selection Process. <br /> <br /> (a) Public Hearing Required. The City Council shall hold <br />a public hearing to review submitted projects at least once a year at <br />an appropriate date as determined by the City Council. Such a hearing <br />date should follow the Council's setting of the yearly development <br />allocation by sufficient time to allow potential developers to process <br />new development applications prior to the cut-off date for the selec- <br />tion of projects. <br /> <br /> -7- <br /> <br /> <br />
