Section 2-20.06. Establishment of Yearly Allocation and Its <br /> Apportionment. <br /> <br /> (a) Establishment of Allocation. The City Council, follow- <br /> lng a public hearing, shall annually establish the number of resi- <br /> dential units which may be approved pursuant to Section 2-20.10. In <br /> making its allocation, the City Council shall consider the following: <br /> <br /> (1) The general plan growth rate; <br /> <br /> (2) The outstanding capacity at the Sunol and DSRSD <br /> sewage treatment plants; <br /> <br /> (3) The number of residential units previously <br /> authorized but not developed; <br /> <br /> (4) The number of residential units authorized in <br /> previous years; <br /> <br /> (5) Anticipated development resulting from the <br /> 1972 Settlement Agreement and other litigation; <br /> and <br /> <br /> (6) Comments received at the public hearing held in <br /> conjunction with the allocation. <br /> <br /> (b) Apportionment of Yearly Allocation Between Single- <br /> Family and Multiple Units. The City Council shall determine the <br /> annual distribution of the residential allocation between single- <br /> family and multiple-family residential uses. In making its determin- <br /> ation, the City Council shall consider the following: <br /> <br /> (1) The general plan policies concerning the mix of <br /> residential uses; and <br /> <br /> (2) The allocation priorities established by the 1972 <br /> Settlement Agreement. <br /> <br /> (c) Allocation for Subsidized, Lower-Income Housing. The <br />City Council shall establish a special allocation equal to 10% of the <br />yearly allocation which shall be available for any subsidized, lower- <br />income housing development. For the purposes of this subsection, <br />"subsidized, lower-income housing development" shall mean a project <br />(whether sponsored by a housing authority, non-profit corporation, <br />profit-making corporation, or other sponsor) qualifying for any state <br />or federal subsidized housing program designed to provide housing to <br />households eligible for federal lower-income housing assistance pro- <br />grams as defined by the Department of Housing and Urban Development. <br /> <br /> Section 2-20.07. Development Approval for Exemp~ and Subsidized, <br /> Lower-Income Projects. <br /> <br /> (a) Single-Family Lots. Proposed development of single- <br />family residences qualifying as exempt under Section 2-20.05(a) may <br /> <br /> -5- <br /> <br /> <br />
