Staff Recommendation <br /> Staff recommends the City Council determine that roads are not to be considered <br /> structures for the purpose of implementing Measure PP, and introduce the draft <br /> ordinance approving the proposed Code Chapter. If the City Council disagrees <br /> with staffs position, staff suggests the City Council revise the proposed Code <br /> Chapter with the following language: <br /> Modify Section 18.70.020 C. <br /> C. Grading to construct the above-referenced residential or commercial <br /> structures and to construct public and/or private streets or roads is <br /> prohibited on hillside slopes of a 25 percent grade or greater, or within <br /> 100 vertical feet of a ridgeline. <br /> Add Section 18.70.050 I.: <br /> I. Streets and Roads (Public and/or Private). <br /> Public and private streets and/or roads serving residential or <br /> commercial structures are structures and are subject to the regulations of <br /> this Chapter. <br /> 3. Predetermined Ridgelines. <br /> Planning Commission Recommendation <br /> The City Council should consider directing staff to create an inventory of ridgelines <br /> that when completed would be incorporated into the proposed Code Chapter. <br /> Staff Response <br /> Staff does not concur with the Planning Commission's recommendation. <br /> The Planning Commission believed that the inventory of ridgelines would provide <br /> early disclosure to the property owners and applicants on hillside developments. <br /> Staff prefers to identify and evaluate ridgelines on a case-by-case basis with <br /> individual development applications to avoid the delays in adopting the ordinance <br /> that could be expected from this exercise. <br /> Staff Recommendation <br /> Staff recommends no change to the proposed Code Chapter. <br /> PUBLIC NOTICE <br /> Notice of this item was published in The Valley Times. Written notices of the public <br /> meeting were sent to the people who spoke at the City Council's Special Meeting and at <br /> the Planning Commission public hearings. At the time that the City Council staff report <br /> was written, staff had not received any additional written or verbal comments. Staff will <br /> forward to the City Council any new public comment received after publication of the staff <br /> report. <br /> Page 9of11 <br />
