Staff Recommendation Staff recommends the City Council determine that roads are not to be considered structures for the purpose of implementing Measure PP, and introduce the draft ordinance approving the proposed Code Chapter. If the City Council disagrees with staffs position, staff suggests the City Council revise the proposed Code Chapter with the following language: Modify Section 18.70.020 C. C. Grading to construct the above-referenced residential or commercial structures and to construct public and/or private streets or roads is prohibited on hillside slopes of a 25 percent grade or greater, or within 100 vertical feet of a ridgeline. Add Section 18.70.050 I.: I. Streets and Roads (Public and/or Private). Public and private streets and/or roads serving residential or commercial structures are structures and are subject to the regulations of this Chapter. 3. Predetermined Ridgelines. Planning Commission Recommendation The City Council should consider directing staff to create an inventory of ridgelines that when completed would be incorporated into the proposed Code Chapter. Staff Response Staff does not concur with the Planning Commission's recommendation. The Planning Commission believed that the inventory of ridgelines would provide early disclosure to the property owners and applicants on hillside developments. Staff prefers to identify and evaluate ridgelines on a case-by-case basis with individual development applications to avoid the delays in adopting the ordinance that could be expected from this exercise. Staff Recommendation Staff recommends no change to the proposed Code Chapter. PUBLIC NOTICE Notice of this item was published in The Valley Times. Written notices of the public meeting were sent to the people who spoke at the City Council's Special Meeting and at the Planning Commission public hearings. At the time that the City Council staff report was written, staff had not received any additional written or verbal comments.
