(1) Eligible Projects. Projects eligible <br /> to be covered by long-term agreements shall meet the <br /> following criteria: <br /> <br /> (i) Contain a minimum of 100 units; for <br /> purposes of meeting this minimum <br /> project size requirement, projects <br /> with prior RAP phased approvals may <br /> count all units in the phased <br /> approval for which building permits <br /> have not been received as part of <br /> the "project." <br /> <br /> (ii)Contain sufficient information <br /> about the project which is to be <br /> the subject of the long-term agreement <br /> for the Council to enter into a <br /> long-term agreement, the sufficiency <br /> of the information to be determined <br /> by the City Council in its sole <br /> discretion. Prior governmental <br /> approvals as enumerated in subsection <br /> 2-20.05(b)(5) would normally <br /> suffice although no prior governmental <br /> approvals are required. <br /> <br /> (2) Application Procedure. Any developer of <br /> a project meeting the eligibility requirements for <br /> long-term agreements may request a long-term agreement <br /> in accordance with the guidelines for preparation and <br /> negotiation of such agreements established pursuant to <br /> Section 2-20.08. The decision to enter into a long- <br /> term agreement shall be at the sole discretion of the <br /> City Council. <br /> <br /> (3) Contents of Long-TermAgreement. The <br /> long-term agreement shall contain the number of units <br /> per year the developer shall be allowed to construct. <br /> The agreement may also contain any other terms as may <br /> be mutually agreed upon which may be necessary to <br /> promote the public health, safety, and general welfare <br /> and conform the project to all General Plan goals and <br /> policies. <br /> <br /> (b) Yearly Allocation for Smaller Pro~ects. All <br />non-exempt projects not covered by long-term agreements <br />shall be required to secure development approval under the <br />yearly allocation process described in this subsection and <br />as may be further delineated in the guidelines established <br />pursuant to Section 2-20.08. <br /> <br /> <br />
