Section 2-20.03. Allocation Required. Except as <br />otherwise provided in this Chapter, no subdivision shall be <br />accepted for filing which creates residentially developable <br />lots nor shall any building permit be issued for any new <br />residential unit, including a mobile home, unless the development <br />has received development approval from the City Council <br />pursuant to Section 2-20.05. <br /> <br /> Section 2-20.04 Exemptions. The provisions of Section <br /> 2-20.03 of this Chapter shall not be applicable to the <br /> following projects: <br /> <br /> (a) Construction of one single-family residence <br />on a legally existing, R-1 or A zoned lot, including lots <br />legally in existence prior to the effective date of this <br />ordinance and lots legally created under subsection (b) <br />below. <br /> <br /> (b) Subdivisions of four (4) or fewer residential <br /> lots. <br /> <br /> (c) Projects which have entered into special <br />agreements with the City to participate in the Mortgage <br />Revenue Bond Program. <br /> <br /> (d) Affordable housing projects selected by the <br />City Council for development through the City's affordable <br />housing competition. <br /> <br /> (e) Mobile homes and other living quarters proposed <br />for erection on school sites and commercial properties for <br />security purposes, not exceeding one dwelling per site. <br /> <br /> (f) Proposals for condominium conversion subdivisions. <br /> <br /> (g) Lower-income housing developments using the <br />allocation established for such developments as set forth in <br />Section 2-20.05(b)(2) of this Chapter. <br /> <br />Development approval for exempt projects shall be governed <br />by the provisions of the Growth Management Program guidelines <br />established pursuant to Section 2-20,12. <br /> <br /> Section 2-20.05 Development Approval Process. <br /> <br /> (a) Long-Term Agreements. It is the intent of <br />the long-term agreement provision to afford larger projects <br />the opportunity to efficiently plan and develop their projects <br />within a framework of a city-wide controlled growth rate in <br />accordance with its General Plan while affording a continuing <br />opportunity for smaller projects to develop as well. The <br />long-term agreement shall constitute the developPent <br />approval for the entire project so long as the project <br />proceeds in accordance with its terms and conditions. <br /> <br /> <br />
