6) is designed to complement the architectural form and detailing of the grocery <br /> store and retail buildings; <br /> 7) proposes landscape planting that will soften and frame the views of the site and <br /> buildings from Bernal Avenue and will comply with the State of California's <br /> Model Water Efficient Landscape Ordinance and Bay Friendly Basics; <br /> 8) includes building and monument signs that match the Comprehensive Sign <br /> Program standards of the Pleasanton Gateway Development; and, <br /> 9) is designed to drain its stormwater towards the existing bioswales constructed <br /> with the Pleasanton Gateway development. <br /> PUD MAJOR MODIFICATION FINDINGS <br /> Please refer to the attached, July 25, 2012, Planning Commission Staff Report, for a <br /> discussion of the considerations needed to approve the proposed Major Modification of <br /> the PUD development plan. <br /> CONDITIONAL USE PERMIT FINDINGS <br /> Please refer to the attached, July 25, 2012, Planning Commission Staff Report, for a <br /> discussion of the considerations needed to approve the proposed Conditional Use <br /> Permit. <br /> PUBLIC COMMENT <br /> Public notices were sent to all property owners and tenants that had received notices of <br /> the previous Pleasanton Gateway development applications. Staff received one written <br /> communication from a noticed property owner supporting the proposed gas station. <br /> Any additional comments or concerns received from adjacent owners or tenants before <br /> the public hearing will be forwarded to the City Council as they are received. <br /> ENVIRONMENTAL ASSESSMENT <br /> Environmental review for the proposed project is covered by the Mitigated Negative <br /> Declaration (MND) approved for PUD-02-07M. The physical environment has not <br /> significantly changed since that time; no newer information or changed circumstances <br /> which require additional CEQA review has been identified to the City. Because the <br /> proposed service station would replace a previously approved building for this portion of <br /> the Pleasanton Gateway development and would have a negligible effect on the levels- <br /> of-service on nearby City streets and intersections, the Mitigated Negative Declaration <br /> can be used to cover the proposed modification in conformance with the standards of <br /> the California Environmental Quality Act (CEQA). The analysis in the adopted Mitigated <br /> Negative Declaration has been supplemented by a detailed queuing analysis (see <br /> Attachment #6). It should be noted that the proposed gas station is also subject to the <br /> review and approval by the by the Livermore-Pleasanton Fire Department and by the <br /> San Francisco Bay Area Air Quality Management District. <br /> As required by PUD-02-07M, the applicant is conditioned to have a qualified <br /> archaeologist present on site during the grading and trenching for the foundation(s), <br /> utility services, or other on-site excavation, in order to determine if any bone, shell, or <br /> artifacts are uncovered. <br /> Page 8 of 10 <br />
