43. That the deed restrictions for each lot indicate to potential buyers the responsibility of the owners for maintenance and repair of all common areas, roadways and private utility and service systems · ' 44. That the fire hydrant and water system be designed to provide a water flow of 1500 gpm. 45. That the fire hydrants and.other Fire Department con- nections shall be located and sized as directed by the City Fire Chief. 46. That 20 ft. wide fire retardant buffers shall be pro- vided around site structures on sites 5 through 9. 47. That all exterior roofing and siding of all structures shall be fire retarding. 48. That all~landscaping of the sites 5 through 9, 13, 14, 15 through 18 and 24 if approved, complement the natural setting and limit the use of water for irrigation in order to minimize water saturation. 49. That all private roadways and private utility systems on the project site shall be owned, maintained, and repaired and operated by the homeo~mers association. 50. That prior to the filing of a final map, the CC&Rs for the project shall be approved by the City Attorney.- The CC&Rs shall provide for a homeowners association with sufficient power to manage the common open space areas, and operate and maintain all commonly owned areas and facilities. The budget, bylaws, and accounting systems shall also receive City staff approval before a final map may be filed. 51. That the CC&Rs shall provide: a. that the'City be granted an irrevocable right- of-entry for public safety and municipal purposes; b. that if the project is to contain any private utility systems, the homeowners association shall maintain at all times a contract with a private or public entity,.approved by the City, to maintain, repair and inspect those systems. Such maintenance contract shall provide that the Contractor file with the City Engineer semi-annually or annually a report certi- fying that those systems are in good repair and being properly maintained.. The Contractor shall report all problems, wear and tear on the systems, and expected future service needs; and c. that the City shall be named as a beneficiary of said CC&Rs and granted the power to enforce its provisions if the homeowners association fails to do so. -6-
