The Administrative Non-Profit is responsible for securing the food storage units and <br /> issuing unit keys to the Organizations. The City is not responsible for security of the <br /> food storage units. <br /> 2. Maintenance. During Organizations' use of the Site for the Regional Food Storage <br /> Project, Organizations shall, as agreed between them, maintain the following: <br /> (a) Storage units lighting, compressors, locks, unit keys, hinges, handles and paint; <br /> (b) Fence integrity and color; <br /> (c) Site cleanliness, including, but not limited to: exterior of food storage units kept <br /> free of trash, litter and graffiti; removal and disposal of trash and litter on the Site <br /> grounds within fenced areas around food storage units; no food items, boxes, <br /> pallets, etc. placed or stored outside of units; trash and litter placed into properly <br /> sized and closed disposal containers. <br /> a. Organizations shall be responsible to move disposal containers outside <br /> of the fenced Site area on the afternoon or evening before regularly <br /> scheduled waste collection days to designed area for pick-up/ emptying. <br /> After waste collection, Organizations shall return disposal containers into <br /> the fenced Site area within 24 hours. <br /> b. Organizations acknowledge that during the term of this MOU, new <br /> County-wide requirements may mandate additional disposal containers <br /> for compostable materials, and Organizations will be required to comply <br /> with such regulations. <br /> 3. Costs. Organizations, as agreed between them, shall directly pay, or reimburse the City, <br /> for the following costs: <br /> (a) Access Keys. Access keys lost, stolen or damaged due to negligence by <br /> Organization may be replaced by the City after the Organization submits a request <br /> for a replacement access key and pays the City the current cost for such <br /> replacement access keys. <br /> When any access key is lost or stolen, the Organization responsible for such key <br /> shall immediately inform the City by telephone at (925) 931-5500 or electronic mail at <br /> dlozano @ci.pleasanton.ca.us, so that locks to enter the Site can be changed as <br /> soon as reasonably possible at the expense of the responsible organization. <br /> (b) Electricity. Organizations shall reimburse the City for electricity costs for the <br /> Regional Food Storage Project. City will submit to the Administrative Non-Profit by <br /> email or U.S. Mail the invoice for such electricity costs quarterly. Administrative Non- <br /> Profit shall coordinate payment to the City within thirty (30) days. <br /> (c) Damage to City Property. Each Organization will pay for the cost of repair or <br /> replacement of City improvements to the Site at the Operation Services Center which <br /> are damaged by the Organization's officers, employees, agents, invitees, and <br /> volunteers. <br /> 4. Separate Agreement between the Organizations. The parties acknowledge that the <br /> Regional Food Storage Project will be successful only upon cooperation and coordination <br /> between all of the Organizations regarding the use of the food storage units and sharing of <br /> costs and maintenance responsibilities.
