WHERTEAS, the principal source of this traffic is the three gravel <br /> companies operating in the City and to the east of <br /> Pleasanton in the unincorporated area; and <br /> <br />~EREAS, judicial decisions in California have required that there <br /> be reasonable alternate routes for businesses where <br /> weight restrictions have been imposed; and <br /> <br />~HEREAS, two of the companies, Kaiser Industries and Rhodes-Jamieson, <br /> have access to interstate 580 and 680 by a reasonable <br /> alternative route namely E1 Charro Road and the third <br /> company, Lone Star Industries, has access to 1-580 <br /> by the reasonable alternative route of Stanley Boulevard, <br /> First Street and North Livermore Avenue and to 1-680 <br /> by the reasonable alternative route of Isabelle, Vineyard <br /> and State Route 84; and <br /> <br />WHEREAS, a reasonable alternative route exists for other through <br /> commercial traffic with vehicle weights in excess of <br /> the 16,000 pounds limitation by way of Interstate 580 <br /> and 680; and <br /> <br />~EREAS, the city has provided sixty (60) days' notice pursuant <br /> to Vehicle Code Section 35705 and a public hearing was <br /> held on December 22, 1980, as well as numerous public <br /> hearings on the proposed ordinance, its immediate <br /> precursers and the EIR's for this ordinance. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON ORDAINS <br />AS FOLLOWS: <br /> <br />Section 1: To amend Title V (Vehicles and Traffic, Streets and <br /> Highways), Chapter 5 (Commercial Vehicle Regulations) <br /> to read as follows: <br /> <br /> ARTICLE 2 <br /> <br /> ADDITIONAL WEIGHT LIMITATIONS <br /> <br />Section 5-5.10 Intent and Authority. It is the intent of this <br /> article to impose additional weight limitations on <br /> certain designated commercial routes established in <br /> Article 1 (Prohibition of Certain Streets) of this <br /> chapter, which prohibits commercial vehicles in excess <br /> of three tons from the streets of Pleasanton except <br /> for the designated commercial routes. This Article <br /> 2 will prohibit heavier vehicles in excess of eight <br /> tons from the commercial routes. The authority for <br /> this article is California Vehicle Code Section 35701. <br /> <br /> -2- <br /> <br /> <br />
