CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALA~.~DA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 954 <br /> <br /> AN ORDINANANCE AMENDING TITLE V (VEHICLES A~D TRAFFIC), <br /> CHAPTER 5 (CO~4ERCIAL VEHICLE REGULATION) BY ADDING <br /> ARTICLE 2 TO PROttlBIT OVERWEIGttT VEHICLES FROM <br /> CERTAIN ROADS. <br /> <br />WHEREAS, the Ordinance Code of the City of Pleasanton currently <br /> prohibits all commercial trucks with gross weight in <br /> excess of three tons from traversing city streets <br /> except on designated commercial routes; and <br /> <br />WHEREAS, the Code establishes First Street, Stanley Boulevard <br /> and Sunol Boulevard as designated commercial routes;and <br /> <br />WHEREAS, the increasing use of these commercial routes by vehicles <br /> with gross weight in excess of 16,000 pounds has caused <br /> and continues to cause damage to the roadway, dust, noise, <br /> air pollution, and traffic congestion., thereby impacting <br /> on and endangering those living along the commercial <br /> route, the school children attending school along the route <br /> and residents of the City who use or cross the commercial <br /> route; and <br /> <br />~{EREAS, the City has investigated the effects of establishing an <br /> additional weight limitation over the Stanley Boulevard, <br /> First Street, Sunol Boulevard route and has prepared an <br /> Environmental Impact Report (including a Draft and Final <br /> EIR and a Draft Supplement to the EIR and Final Supplement <br /> to the EIR) detailing the impacts associated with various <br /> methods to reduce or eliminate the adverse impacts of <br /> vehicles in excess of 16,000 pounds using this route; and <br /> <br />WHEREAS, the California Environmental Quality Act and State and <br /> local guidelines require this City Council to make findings <br /> where an EIR identifies one or more significant effects <br /> which may result from approval of the project; and <br /> <br />~{EREAS, the City Council has made findings relative to those <br /> significant effects which may result from adoption of the <br /> proposed ordinance, said significant effects, findings, <br /> and summary of facts supporting those findings being <br /> enumerated in the attached '~Environmental Impact Findings <br /> and Statement of Overriding Considerations," a copy of <br /> which is attached hereto and is incorporated by reference; <br /> and <br /> <br />WHEREAS, the City Council has determined that the public interest <br /> is best served by adopting the proposed ordinance in <br /> spite of the potential significant adverse environmental <br /> effects for the reasons summarized in the aforementioned <br /> attached "Environmental Impact Findings and Statement of <br /> Overriding Considerations;" and <br /> <br /> <br />
