ATTACHMENT 1 <br /> RESOLUTION NO. 12- <br /> RESOLUTION DENYING THE APPEAL OF BRIAN AND CHRISTINE BOURG, <br /> THEREBY UPHOLDING THE PLANNING COMMISSION'S APPROVAL OF THE <br /> APPLICATION OF DAVE AND FRANCINE CUNNINGHAM FOR DESIGN REVIEW <br /> TO REPLACE THE APPROXIMATELY 482-SQUARE-FOOT, SINGLE-STORY <br /> HOUSE LOCATED AT 205 NEAL STREET WITH AN APPROXIMATELY <br /> 1,844-SQUARE-FOOT TWO-STORY RESIDENCE AND FOR VARIANCES FROM <br /> THE PLEASANTON MUNICIPAL CODE TO: (1) REDUCE THE FRONT YARD <br /> SETBACK FROM THE REQUIRED 23 FEET TO 20 FEET; (2) ALLOW ONE <br /> REQUIRED OFF-STREET PARKING SPACE TO BE LOCATED IN THE FRONT <br /> YARD SETBACK; AND (3) ALLOW TANDEM PARKING, AS FILED UNDER CASE <br /> NO. P11-0709 AND P11-0717 <br /> WHEREAS, Dave and Francine Cunningham applied for Design Review <br /> approval to replace the approximately 482-square-foot, single-story house located at <br /> 205 Neal Street with an approximately 1,844-square-foot two-story residence and for <br /> variances from the Pleasanton Municipal Code to: (1) reduce the front yard setback <br /> from the required 23 feet to 20 feet to accommodate the new house; (2) allow one <br /> required off-street parking space to be located in the required front yard setback; and <br /> (3) allow tandem parking; and <br /> WHEREAS, zoning for the property is R-1-6,500 (One-Family Residential) <br /> District and the replacement of the existing home is allowed pursuant to Pleasanton <br /> Municipal Code sections 18.120.030 (addition to nonconforming residential use), <br /> 18.120.040 and 18.120.050 (replacement of nonconforming residential use rebuilt at <br /> same density); and <br /> WHEREAS, at its meetings of April 13, 2011, November 9, 2011, and November <br /> 30, 2011, the Planning Commission, having considered all public testimony, relevant <br /> exhibits, and recommendations of City staff concerning this application, approved the <br /> application, which was revised prior to the November 30, 2011 meeting, and adding for <br /> the record that it does not support future subdivision of the property; and <br /> WHEREAS, within the time specified by the Pleasanton Municipal Code, Brian <br /> and Christine Bourg submitted an appeal of the decision of the Planning Commission to <br /> the City Council; and <br /> WHEREAS, at its meeting of January 17, 2012 the City Council received a report <br /> from the Director of Community Development, together with a copy of the staff report to <br /> the Planning Commission, regarding this matter; and <br /> WHEREAS, the City Council held a public hearing on January 17, 2012, at which <br /> time the appellants, applicants and other members of the public were offered an <br /> opportunity to present evidence regarding the appeal; and <br /> 1 <br />
