each member of the public, a non-exclusive, unencumbered right to pass through a <br /> portion of a property belonging to others. <br /> The non-exclusive nature of this easement allows Lehman-Selway the ability to <br /> dedicate all or any portion of the roadway to the City, to construct the curvilinear <br /> alignment of Cameron Avenue, and to construct the sidewalk along the north side of <br /> Cameron Avenue without having to secure the permission from another property owner. <br /> As the Lehman-Selway property project is proposed, the right-of-way dedication <br /> increases the width of the existing improved roadway that has been partially constructed <br /> within the original private roadway easement, does not restrict access to any lots, and <br /> does not restrict access to any member of the public. This issue is further detailed in <br /> the attached letter from Keir & Wright. <br /> Staff remains satisfied that the proposed project does not "over-burden", change or <br /> restrict, the intended use of the of the private roadway easement that was created in <br /> 1894. <br /> What will be done about the portion of the Woodall's property that extends out <br /> into Cameron Avenue? <br /> As described in the agenda report dated November 15, 2011, dedication of the portion <br /> of the lot known as 3710 Cameron Avenue that extends into right-of-way was offered by <br /> previous owners and accepted by the City, but was never recorded with the County <br /> Recorder. The current owners have agreed to sell this portion of their lot to the City for <br /> fair compensation. The amount of compensation will be negotiated based on an <br /> appraisal from a mutually agreed upon professional appraiser. <br /> Are the amenities provided by this project adequate for the proposed density <br /> increase from 25 new lots to 29 new lots? <br /> Policy 11 of the Pleasanton General Plan states that Low- and Medium-Density <br /> Developments above the midpoint density should "...contain sufficient public amenities <br /> to justify the higher density." <br /> Amenities are provided with this development and include: 1) constructing the <br /> curvilinear alignment of Cameron Avenue at the request of neighbors requests for traffic <br /> calming; 2) constructing a new public sidewalk along the entire north side of Cameron <br /> Avenue from Palmer Drive to Martin Avenue in response to the neighbors' requests for <br /> a sidewalk to the public sidewalk along the east side of Martin Avenue; 3) property <br /> conveyed to the Palmer Drive owners at their request to increase the size of their rear <br /> yards; and, 4) property conveyed to two Trenery Drive owners at their request so that <br /> they can walk around their accessory structures. The proposed amenities provide a <br /> benefit to the future owners of this development as well as to the homeowners of the <br /> surrounding neighborhoods. <br />
