City of Pleasanton <br /> East Bay Regional Park District <br /> PLEASANTON RIDGE/AUGUSTIN BERNAL PARK <br /> OPERATING AGREEMENT <br /> THIS AGREEMENT is made this day of , 2011, between <br /> the City of Pleasanton, a municipal corporation (hereafter "City") and the East Bay Regional Park <br /> District, a California special district formed pursuant to section 5500 et seq. of the California Public <br /> Resources Code (hereafter "District"). <br /> RECITALS <br /> WHEREAS, CITY and DISTRICT own and hold contiguous parklands of a similar nature <br /> on Pleasanton Ridge ("Ridge") for the purpose of operating and maintaining park and open space <br /> lands for public use; and <br /> WHEREAS, CITY and DISTRICT and the public will realize benefit from the CITY and <br /> DISTRICT cooperating in the operation and the sharing of certain services that are necessary for <br /> safe park operation. <br /> NOW, THEREFORE, in consideration of the mutual promises expressed herein, the <br /> parties agree as follows: <br /> I. PUBLIC ACCESS <br /> A. Members of the public may access the Ridge at specified locations on the <br /> contiguous boundaries of CITY and DISTRICT parklands and may travel on <br /> designated trails on lands belonging to each agency. The locations for designated <br /> trail access are set forth on Exhibit "A" <br /> B. Nothing in this section or Agreement is intended to permit vehicular access by <br /> the public to the upper areas of the Ridge. Because significant restrictions <br /> concerning vehicular access apply to CITY-owned property along the Ridge, <br /> DISTRICT shall discuss with CITY and receive written approval from the City <br /> prior to any of the DISTRICT's plans to permit public vehicular access to its <br /> ridgetop property prior to permitting same. <br /> C. The public will be subject to the rules and regulations which each agency enforces <br /> on its own property. Each agency will inform the other of changes to park rules <br /> in advance and discuss possible modifications of park rules to reduce confusion <br /> for park users and to facilitate enforcement. <br /> 2. PUBLIC SAFETY <br /> The respective law enforcement departments of each agency shall cooperate with one <br /> another. The fire departments of each agency shall maintain regular communications <br />
