City of Pleasanton
East Bay Regional Park District
PLEASANTON RIDGE/AUGUSTIN BERNAL PARK
OPERATING AGREEMENT
THIS AGREEMENT is made this day of , 2011, between
the City of Pleasanton, a municipal corporation (hereafter "City") and the East Bay Regional Park
District, a California special district formed pursuant to section 5500 et seq. of the California Public
Resources Code (hereafter "District").
RECITALS
WHEREAS, CITY and DISTRICT own and hold contiguous parklands of a similar nature
on Pleasanton Ridge ("Ridge") for the purpose of operating and maintaining park and open space
lands for public use; and
WHEREAS, CITY and DISTRICT and the public will realize benefit from the CITY and
DISTRICT cooperating in the operation and the sharing of certain services that are necessary for
safe park operation.
NOW, THEREFORE, in consideration of the mutual promises expressed herein, the
parties agree as follows:
I. PUBLIC ACCESS
A. Members of the public may access the Ridge at specified locations on the
contiguous boundaries of CITY and DISTRICT parklands and may travel on
designated trails on lands belonging to each agency. The locations for designated
trail access are set forth on Exhibit "A"
B. Nothing in this section or Agreement is intended to permit vehicular access by
the public to the upper areas of the Ridge. Because significant restrictions
concerning vehicular access apply to CITY-owned property along the Ridge,
DISTRICT shall discuss with CITY and receive written approval from the City
prior to any of the DISTRICT's plans to permit public vehicular access to its
ridgetop property prior to permitting same.
C. The public will be subject to the rules and regulations which each agency enforces
on its own property. Each agency will inform the other of changes to park rules
in advance and discuss possible modifications of park rules to reduce confusion
for park users and to facilitate enforcement.
2. PUBLIC SAFETY
The respective law enforcement departments of each agency shall cooperate with one
another. The fire departments of each agency shall maintain regular communications
