1) If the Operator is canceled by the vehicle's registered owner or agent prior to the <br /> Operator taking possession of the vehicle, there shall be no charges for towing. The <br /> Operator shall immediately contact the PPD and advise it of the cancelation. The <br /> Operator shall then be placed back on top of the tow list. <br /> i. Possession is deemed to arise when the vehicle is removed and is in <br /> transit, or when the vehicle recovery operations or load salvage <br /> operations have begun (Civil Code (CC) §3068.1(a) and Vehicle Code <br /> (CVC) §2285[a][1]). <br /> ii. Whenever a vehicle's owner returns to a vehicle that is in possession of <br /> an Operator prior to the removal of the vehicle,the owner may regain <br /> possession of the vehicle from the Operator if the owner pays the <br /> Operator the towing charges(CVC§22851[a][2]). <br /> 2) If service other than towing, recovery, and load salvage has begun by the Operator <br /> and the service Is canceled by the vehicle's registered owner or agent,the Operator <br /> may charge the vehicle's registered owner one-half the regular hourly service <br /> charges for the time expended on the call. For purposes of cancellation, service <br /> begins when physical work on the vehicle has begun, not the response. No charge <br /> or lien shall arise for the service unless the Operator has presented a written <br /> statement to the vehicle's registered owner or agent for the signed authorization <br /> for the services to be performed. The Operator shall not attempt to take possession <br /> of the vehicle in order to establish a lien for any non-towing services performed,or <br /> initiated and subsequently canceled, when not entitled to such a lien by law. <br /> E. An Operator may dispatch more than one tow truck to a multi-vehicle collision, but <br /> there shall be no additional charge for any personnel or equipment that is not necessary <br /> to perform the required service. <br /> F. If two or more Operators are called to the same incident, distribution of the vehicles <br /> shall be at the discretion of the Police Supervisor or Officer on scene. <br /> G. The PPD shall determine at its discretion the number of Operators on the Tow Rotation <br /> List. <br /> H. Participation in the Rotation Tow Program is voluntary. <br /> 2011-2013 TSA Page 6 of 30 <br />
