5. OPERATORS <br /> A. An Operator shall have a minimum of three verifiable years of for-hire towing <br /> experience, as an owner or principal, prior to the final filing date of an enrollment <br /> period. Ownership status shall be determined by the PPD. <br /> B. An Operator who does not meet the three year verifiable for-hire towing experience <br /> may be considered for a position on the Rotation Tow List if a full time manager is <br /> employed who possesses at least three years verifiable tow experience. Managerial <br /> experience shall be decided by the PPD. Managerial experience may be established by <br /> the following; <br /> 1) Proper and legal release of vehicles and property, completion and filing of lien <br /> paperwork and handling other tow related documents. <br /> 2) Having the authority to conduct all company business, and execute documents on <br /> behalf of the company, including the TSA and the Application for Rotation Tow <br /> Listing. <br /> If the manager ceases to be employed by the company,the TSA with that Operator shall <br /> be terminated until a new manager can be approved by the PPD. <br /> C. An Operator shall have a minimum of three trucks (one of which shall be a car carrier). <br /> In the event that an Operator falls below the required three trucks for more than seven <br /> calendar days due to engine mechanical failure or a collision,the Operator shall notify <br /> the PPD within 48 hours thereafter. <br /> D. An Operator's place of business shall have a sign that clearly identifies it to the public as <br /> a tow service. The sign shall have letters that are clearly visible to the public from the <br /> street and shall be visible at night. Business hours shall be posted clearly visible to the <br /> public. <br /> E. Offices staffed with only one employee may be closed for one hour at lunch. A sign shall <br /> be posted stating the reason for the closure. The sign shall have a telephone number to <br /> call which shall result in an immediate response by the Operator for the release of <br /> property or vehicles. Response to the office shall be within the time frame required by a <br /> normal PPD Class A tow. <br /> F. "Normal business hours"for Operators shall not be less than 8:00 a.m.to 5:00 p.m., <br /> Monday through Friday, except for the following state recognized holidays: New Years <br /> Day, Martin Luther King's Day, Lincoln's Birthday,Washington's Birthday, Cesar Chavez <br /> Day, Memorial Day, Independence Day, Labor Day, Columbus Day,Veteran's Day, <br /> Thanksgiving Day,the day after Thanksgiving Day, and Christmas Day(CVC§ 22851[b]). <br /> 2011-2013 TSA Page 7 of 30 <br />
