5. OPERATORS A. An Operator shall have a minimum of three verifiable years of for-hire towing experience, as an owner or principal, prior to the final filing date of an enrollment period. Ownership status shall be determined by the PPD. B. An Operator who does not meet the three year verifiable for-hire towing experience may be considered for a position on the Rotation Tow List if a full time manager is employed who possesses at least three years verifiable tow experience. Managerial experience shall be decided by the PPD. Managerial experience may be established by the following; 1) Proper and legal release of vehicles and property, completion and filing of lien paperwork and handling other tow related documents. 2) Having the authority to conduct all company business, and execute documents on behalf of the company, including the TSA and the Application for Rotation Tow Listing. If the manager ceases to be employed by the company,the TSA with that Operator shall be terminated until a new manager can be approved by the PPD. C. An Operator shall have a minimum of three trucks (one of which shall be a car carrier). In the event that an Operator falls below the required three trucks for more than seven calendar days due to engine mechanical failure or a collision,the Operator shall notify the PPD within 48 hours thereafter. D. An Operator's place of business shall have a sign that clearly identifies it to the public as a tow service. The sign shall have letters that are clearly visible to the public from the street and shall be visible at night. Business hours shall be posted clearly visible to the public. E. Offices staffed with only one employee may be closed for one hour at lunch. A sign shall be posted stating the reason for the closure. The sign shall have a telephone number to call which shall result in an immediate response by the Operator for the release of property or vehicles. Response to the office shall be within the time frame required by a normal PPD Class A tow. F. "Normal business hours"for Operators shall not be less than 8:00 a.m.to 5:00 p.m., Monday through Friday, except for the following state recognized holidays: New Years Day, Martin Luther King's Day, Lincoln's Birthday,Washington's Birthday, Cesar Chavez Day, Memorial Day, Independence Day, Labor Day, Columbus Day,Veteran's Day, Thanksgiving Day,the day after Thanksgiving Day, and Christmas Day(CVC§ 22851[b]). 2011-2013 TSA Page 7 of 30
