3. TERM <br /> This Agreement shall commence on September 1, 2011 and expire on June 30, 2013, <br /> unless the City exercises its option to extend the contract for two years commencing <br /> on July 1, 2013. If City elects to extend the Agreement, it shall notify the Operator in <br /> writing that the Agreement is being extended. <br /> 4. ROTATION TOW PROGRAM <br /> A. When an Operator is approved by the PPD for inclusion in the Rotation Tow Program, <br /> and after the Operator has executed the TSA, the Operator shall be placed, along with <br /> other such Operators,on the rotation tow list to provide tow service as requested by <br /> the PPD. Each Operator shall advance up the rotation list after each PPD call for <br /> service, until the Operator is at the top of the list. Once an Operator is at the top of the <br /> rotation tow list,the Operator shall then be the next to be called for service by the PPD. <br /> After completion of the tow,or as otherwise provided in the TSA,the Operator shall go <br /> to the bottom of the rotation tow list and advance up the list until again called for <br /> service by the PPD. <br /> B. Nothing shall prohibit a Police Supervisor or Officer from requesting a specific tow <br /> company when, in the Police Supervisor or Officer's opinion, the Operator at the top of <br /> the rotation tow list cannot clear a hazard as expeditiously as necessary. <br /> 1) In such an instance, after the Operator selected provides service to the PPD, the <br /> Operator would then go to the bottom of the rotation tow list. Operators on the <br /> tow list that were bypassed would remain in the same order until selected for a <br /> rotation for which they are qualified. <br /> C. Nothing shall prohibit a Class B, C, or D Operator from maintaining a place on a lighter <br /> class rotation tow list, provided the tow truck meets the equipment specifications for <br /> that class of operation. <br /> D. One telephone call to an Operator shall constitute one turn on the rotation tow list and <br /> then the Operator shall be moved to the bottom of the tow list. A turn on the rotation <br /> tow list includes instances when the Operator fails to answer the telephone, is unable to <br /> respond, is unable to perform the required service, refuses to respond or otherwise <br /> provide service,or is canceled by the PPD due to excessive response time as determined <br /> by the Police Supervisor or Officer. If the Police Supervisor or Officer determines that <br /> the Operator is not needed and is canceled by the Police Department, up to and <br /> including arrival at the scene and standby time which does not result in a tow,there <br /> shall be no charges and the Operator shall be placed back on the top of the tow list. <br /> 2011-2013 TSA Page 5 of 30 <br />
