CONTRACT <br /> MISCELLANEOUS LANDSCAPE SERVICES <br /> THIS CONTRACT is made and entered into this 1st day of October, 2011 by and <br /> between Tree Sculpture Group. ("Contractor"), whose address is 463 Roland Way, Oakland CA <br /> 94621, and telephone number is (510)562-4000 and the CITY OF PLEASANTON, a municipal <br /> corporation ("City"). <br /> WITNESSETH : <br /> WHEREAS, the City has awarded to the Contractor a contract for Miscellaneous <br /> Landscape Services. <br /> NOW, THEREFORE, in consideration of the mutual promises set forth herein, the parties <br /> agree as follows: <br /> L Work to be Performed. The work will generally consist of maintenance of landscaping, <br /> including trees, shrubs, groundcovers, vines, hardscapes, turf, and irrigation systems all <br /> as delineated on the set of drawings entitled Map of Sites, Miscellaneous Landscape <br /> Services, (Appendix B) and related activities as described in this specification. <br /> Said work is more particularly shown in the following documents which are on file with <br /> the Department of Community Development of the City and are incorporated herein by <br /> this reference: <br /> A. Plans and Specifications entitled the Miscellaneous Landscape Services <br /> and addenda thereto, if any. <br /> B. Contract Amendments approved by the City Manager, done in accordance <br /> with Standard Specifications. <br /> C. The Proposal submitted to the City by the Contractor. <br /> D. Request for Proposals. <br /> E. General Provisions and Special Provisions. <br /> 2. Compensation. The Cily shall pay the Contractor for work actually performed at the unit <br /> prices set out in the Contractor's proposal to the City. The quantities of work stated <br /> therein are estimates only; actual quantities will be measured for payment in accordance <br /> with the specifications. The annual contract amount shall not exceed $400,000. <br /> 3. Contract Renewal. It should be noted that the City and the Contractor shall retain the <br /> right to renew the signed Contract agreement for an additional one-year period up to, but <br /> not exceeding, four additional years. This Contract may be renewed only by mutual <br /> agreement between the parties involved. Each party retains the right to not renew the <br />
