10. That the owner of the parcel immediately north of lot 14 <br /> shall be granted vehicular access over the Deer Oaks Drive if, <br /> prior to the filing of the final subdivision map for subject <br /> project, said owner agrees to share the prorata cost of maintaining <br /> the roadway including insurance costs and gate maintenance and <br /> agrees to abide by all association rules and restrictions on the <br /> use of same. Said vehicular access right-of-way shall be limited <br /> to one user/homeowner of the northerly parcel and guests. <br /> <br />11. That as part of the tentative map approval, the exact location of <br /> the road to lots 7, 8 and 11-13 be established showing retaining <br /> wall location, trees and how the slide area is to be corrected. <br /> <br />12. That the applicant be cognizant of the fact that City approval is <br /> required prior to removal of any heritage sized tree. <br /> <br />13. That as part of the tentative map approval, a precise plan for <br /> the emergency access road to Twelve Oaks Drive shall be submitted <br /> showing retaining walls, and trees to be removed and pruned. <br /> <br />14. That the large oak tree near the existing stable shall be repaired <br /> and maintained in a healthy condition at all times. <br /> <br />15. That the grading plan for the tract shall shown driveway access <br /> for all lots and all tree~ proposed to be removed within the <br /> entire subject site. <br /> <br />16. That if the outfall system along the north side of Bernal Avenue <br /> is not piped to the Arroyo de la Laguna, the existing ditch in <br /> the area shall be regraded from Foothill to the Arroyo to the <br /> satisfaction of the City Engineer. <br /> <br /> 17. That approval of the water system, sanitary sewer system, storm <br /> drain system and utility distribution system be withheld pending <br /> final design. The 8" water line in Twelve Oaks Drive, Tract 4239 <br /> will be required to be extended to tie to the proposed water <br /> system within this development. A regulation station will be <br /> required. The water system will be publicly maintained within a <br /> P.S.E. The sanitary sewer system; the private road system, <br /> including the emergency access road; the storm drain system <br /> within the development shall be privately maintained by the <br /> Homeowners Association. <br /> <br /> 18. That approval for the line, grade, width and structural sections <br /> of all streets and drives within this development be withheld <br /> pending final design. This road system as shown on the development <br /> plan and as amended by the alternative study is generally acceptable. <br /> The emergency access road shall be an all weather road and shall <br /> be designed and constructed to the satisfaction of the City <br /> Engineer and the Fire Marshal. <br /> <br /> <br />
