51. That the CC&Rs shall provide: <br /> <br /> a. that the City be granted an irrevocable right-of-entry <br /> for public safety and municipal purposes; <br /> <br /> b. That if the project is to contain any private utility <br /> systems, the homeowners association shall'maintain <br /> at all times a contract with a private or public <br /> entity, approved by the City, to maintain, repair <br /> and inspect those systems. Such maintenance contract <br /> shall provide that the Contractor file with the City <br /> Engineer semi-annually or annually a report certifying <br /> that those systems are in good repair and being <br /> properly maintained. The Contractor shall report <br /> all problems, wear and tear on the systems, and <br /> expected future service needs; <br /> <br /> co That the homeowners association shall be responsible <br /> for maintenance of all non-buildable areas (all areas <br /> outside of the building envelope) if individual property <br /> owners fail to do so. <br /> <br /> d. that the City shall be named as a beneficiary of said <br /> CC&Rs and granted the power to enforce its provisions <br /> if the homeowners association fails to do so. <br /> <br />52. That all conditions of approval of case PUD-82-13 shall <br /> be listed in the CC&Rs. <br /> <br />53. That an erosion control plan be submitted to and approved <br /> by the City as part of the improvement plan for the subdivision. <br /> <br />54. That a dust control plan be submitted to and approved by <br /> the City prior to the beginning of grading. <br /> <br />55. That there shall be access for emergency vehicles to all <br /> non-buildable areas shown on the development plan. <br /> <br />56. That except as modified by this development plan, the <br /> site standards for all structures on the subject property <br /> shall be those of the R-i-20,000 District. <br /> <br />57. That all utilities required to serve the development shall <br /> be installed und'erground. <br /> <br />58. That the site be kept free of fire hazards from the start <br /> of construction to final inspection and that the Fire <br /> Department emergency number be prov~.ded adjacent to all <br /> telephones on the site. <br /> <br />59. That any use of the coupon area shown on the development <br /> plan must be described in the development plan or amendments <br /> thereto. <br /> <br /> -6- <br /> <br /> <br />
