39. That should any proposed lot not have a buildable site, <br /> such lot shall not be shown on the tentative map as a <br /> separate parcel but shall be included in the open space <br /> lands or be added to neighboring parcels. <br /> <br />40. That no improvement activities, including but not limited <br /> to grading, construction, tree removal or site preparation <br /> shall be initiated until all proper permits are obtained. <br /> <br />41. That a fire retardant buffer 10 fto in width shall be <br /> provided along the length of both sides of the T~,~'e!ve Oaks <br /> Drive private roadway and any other street or drive'~,~ay <br /> required by the Fire Department and be engineered and <br /> landscaped in such a way as to minimize erosion to a <br /> level acceptable to the City Engineer. <br /> <br />42. That street lighting shall. be provided by the dev'eloper <br /> and shall be designed to minimize intrusion of hillside <br /> lighting to the valley floor as concurred with by the <br /> City Planning Division. The lighting system on the <br /> private road shall be approved by the City Engineer, <br /> installed by 'the developer and maintained by the horneo~a~era <br /> association, <br /> <br />43. That the deed restrictions for each lot indicate to <br /> potential buyers the responsibility of the owners for <br /> maintenance and repair of all common areas, roadways and <br /> private utility and service systems. <br /> <br />44. That the fire hydrant and water system be designed to <br /> provide a water flow of 1500 gpm. <br /> <br />45. That the fire hydrants and other Fire Department connections <br /> shall be located and sized as directed by the City Fiz'e Chief. <br /> <br />46. That 20 ft. wide fire retardant buffers shall be ?rovided <br /> around all structures on the sites on Twelve Oaks D'~-L~.'v'e <br /> cul-de-sac. <br /> <br />47. That all exterior roofing and siding of all structures <br /> shall be fire retarding. <br /> <br />48. That all landscaping of the site co~pl. ement the <br /> setting and limit the use of water for irrigation <br /> order to minimize water saturation° <br /> <br />49. That all private roadways and private uti]_ity system~ on <br /> the project site shall be owned, maintained, and to;paired <br /> and operated by the hon~eo~ners association. <br /> <br /> 50. That prior to the filing of a final map, the CC&]",.s for the' <br /> project shall be approved by the City Attorney. The <br /> CC&Rs shall provide for a homeowners association wci. th <br /> sufficient power to manage, operate and maintain all <br /> commonly o~aed areas and facilities. The budget; <br /> and accounting systems shall also receive City staff <br /> approval befo~--e a final n~ap may be filed. <br /> <br /> <br />
